Townsend, Florence E. Townsend &nd Catherine Rothrock, residents of Girard street northwest, between 13th and 14th streets, today flled suit for injunction in the Dis- trict_Supreme Court against Marga- ret E. Kennedy, owner of premises 2523 14th street; Rose A. O'Hanlon, owner of 2801 14th street; Joe Marchl, owner of 2813 14th street, and John Healy, inspector of buildings. ‘The plaintiffs seek to prevent the erection of stores and other buildings beyond the restricted building line of 14th street, under a covenant said to be contained in all the deeds cov- ering ‘property in the John Sherman subdivision of Columbla Heights, ‘The court is also asked to enjoin the inspeotor of bulldings from grant- ing any more permits to owners of property on 14th street to bufld be- yond the restricted 1f of the cov nant. The court is also requested to compel the removal of such buildings as now protrude beyond the building MORSE CASE DEFERRED. Conspiracy Trial Held Up by Ill- ness of One Defendant. Because of the continued illness of Harry F. Morse, one of the defend- ants, Justice Stafford, in Oriminal Division 1, today deferred until to- morrow the calling of the Morse con- spiracy case. Maj. Gordon and coun- sel for the defendants are' expected today to agree on a heart speclalist, who shall go to New London, Conn., and make an exhaustive examination of Morse's condition to see whether he is likely to be able to go to trial this spring. Dr. W. M. Barton, a local specialist on internal medicine, and Dr. D. Percy Hickling, at the request of counsel for Mor. visited New London Sun- dny and examined Mr. Morse. They | both reported to Maj. Gordon that Morse is suffering from muscular in- flammation of the heart and that his removal to Washington at this time would_endanger his health.
