In reply to the sult for $150,000 filed Thursday afternoon in the Dis- trict Supreme Court against the Moore's Theater Corporation for an alleged breach of contract by Boyd C. Cunningham, the Moore’s Theater Corporation through its president Tom Moore, states that there is ab- solutely no’ ground for such a suit. Mr. Moore says that Cunningham did not hold a contract, as represented in a suit, on a percentage basis, but recelved 'a salary of $100 a week Jyhen managing ‘the First National Exchange for Moore's Theater Cor- poration. Mr. Moore further states that the Moore's Theater Corporation disposed of its First National Exchange hold- ings In the year 1919, which he claims uts the suit against his company evond the statute of limitations. Also it is stated Cunningham, on his own account and over his own signature, resigned voluntarily from the company after it was transferred to & New York concern.
