By the Associated Press. HONOLULU, February 5.—United States District Judge J. J. Banks Sat- urday overruled the demurrer filed by the territory to the Injunction obtain- ed by the Japanese language schools restraining the school department from enforcing the regulations pro- viding for the elimination of foreign languages from the first and second grades and the substitution of Eng- lish. The court modified the injunc- tion, however, and held that the school law was constitutional and not a vio- lation of the treaty between the United States and the Japanese. The court's modification of the in- junction provided that all books used in alien schools should be based on the principle that “the pupils’ normal medium of expression is English.” Both the territory and the language schools appealed to the supreme court. Judge Banks also held in his deci- sion that the school department ex- ceeded its authority when it adopted regulations prescribing that all pupils must have completed -the first and second grades in the American schools before they were eligible to attend equivalent grades in the Japanese schools.
