Under the de- cision of Judge McMahon, the de- fendant was, and is, operating his businegs according to the law and not in violation of the zoning law. and his investment of $10,000 will not be molested. Cohen continued the business along the same lines as his predecessor, makMg some minor changes to the layout of the conl and feed yard, It was charged {n the information filed against defendant that he had no right to operate the place as a feed store for the reason that Stryker hade discontinued that line before Cohen took over the business. Cohen was further charged with operating the plant without the required vo- cational permit. Counsel for the defendant brought out the fact that tl protest was based upon personal feeling and nc upon any real violation of the zoning laws. Judge McMahon in* deciding the case held that the defendant was well within his rights; that the oper- ation of the business was not in violatlon of the zoning laws; that erection of or repair or remodeling of the shed did not constitute a violation of the law; that the feed business had not been discontinued and’ that a voecatlonal certificate should be issued to defendant and the business continued as now oper- ated.
