The appointment was made within !a few hours after Judge Wright had {dramaticully taken matters into his {own hands &nd granted the change 01[ {venue to Ada, Okla., and set the case hearing Wednesday. Judges | d Bozarth are in the same district. Judge Wright held he was qualified after Judge Bozarth ! | had’been ruled out. The county attorney alleges he was not given notice the motion was to | be heard. His petition to set aside the change of venue makes the sensational charges that Gov. Robertson recently freed a murderer convict from the | state penitentiary to attend the gov- ernor's trial and “kill the county at- torney of Okmulgee county,” and he asks that if a change of venue is granted the case be set for trial at some point where “the life of said county attorney can and will be pro- tected.” . \ Says Judge Was Bribed. Hepburn also charges that Judge Wright was not qualified to hear the change of venue motion because of alleged collusion with the governor and because of an alleged bribe which } he states the judge has been accused of taking to settle a case. | Gov. Robertson yesterday hotly de- {nied the accusation of Hepburn's pe- tition, which was filed in district court Saturday night. He termed the allegation that he freed a prisoner to | “Kill the county attorney” a ‘“das- tardly lie,” “made at this time for the sole and only purpose of trying to create public sentiment against me on the eve of my case going to trial at Ada.” Bitter Charges Made. The course of Gov. Robertson’s case has been marked with bitter and sensational charges and _counter charges. The indictment which al- {leged acceptance of a bribe to allow ia defunct Okmulgee bank to continue {in operation was returned here last March, only after one judge had dis- missed a grand jury, which it was alleged was on the point of returning an indictment, and feft town. The indictment was returned im- mediately by another court. The gov- ernor appeared to make bond, guard- {ed by officers of the Okluhoma Na- {tional Guard, Charges that the Ku Klux Klan had ja part in bringing about the indict- ment were made by the governor when he filed a petition in the state supreme court for the mandatory re- moval of Judge Mark L. Bozarth, in whose court the instrument was re- turned, from further connection with the case. The mandamus was granted.
