The accident took place on the Lack- | awanna trail, near Hopbottom, not! far trom Scranton, Pa. Smale and three other students of Cornell Uni-| versity were said to have been en! route to Washington for a week end Visit to their homes. Only one of the other students was Injured. Names Are Withheld. One of them was reached at Hope bottom today over the long-distance telephone by a reporter for The Star, but he declined to give the names| of the other students. He said that! only one of the others was slightly | injired and that all three were going bick to the college at Ithaca today Smale, he sald, was in the back seat of the large touring car. CHASTLETON APPEAL DENIED N RENT CASE Justice Siddons of the District Su- preme Court today denied a motion of Attorney W. Gwynn Gardiner, rep- resenting Felix Lake and the Chas- tleton Apartment Corporation, for a temporary restralning order to pro-' vent the Rent Commission from put- ting into operation its determination of reducing rentals in the Chastleton apartments. The petitioners also eought a temporary injunction against the various tenants in the building to prevent them from paying the reduced rental and from demand- ing rebate, as allowed by the Commission. This the court also de- nied. The court decided-that no facts are alleged or principles of law invoked that entitle the plaintiffis to the re- straining order and declared that the the act under which the mission acted is reserved for appel- late tribunals to_deal with, in view of the Supreme Court decision in the Hirsh-Block case. The court points out that the find- ing of the rent commission wes ap- pealed from and the appeal perfected within the necessary ten .days from August 15 last, and this appeal will be heard by the court in general term. McNeill. a tenant and as counsel for other ten- ants. 5 Ténants of the Chastleton, who re- cently organized at the courthouse into a committee, “to protect their interests,” will meet tomorrow night in the assembly room of the Thom- son School, 12th and L streets north- west, to discuss the court’s action and decide on any steps deemed necessary to combat further efforts of their landlord to set aside the rent ruling. The committee is composed of Dr. N. W. Bartram, chairman; T. G. Smith, Elsie Harman, Miss A. R. Van Meter and Mrs. Grace Derhart. —_—— WOMAN IN DOUBLE SHOOTING RECOVERING Mrs. Fannle Goldblum, the con- fessed slayer of Samuel G. Allegro, is rapidly recovering from the bullet wound he inflicted upon her a mo- ment after she had shot him, physi- cians at Emergency Hospital an- nounced today. Mrs. Goldblum now faces a charge of murder, and must stand trial for her life as soon as she is able to leave the hospital. According to Mrs. Goldblum, she shot Allegro when he came to her home at 768 Hobart street nortfiwest Tuesday and demanded that she sur- render to his advances. After she had shot him, Allegro struggled to his feet, seized Mrs, Goldblum by her hair and fired a bullet into her neck from the same revolver with which he had been shot. Allegro died a few hours later.
