We immedi- ately notified our people at Eberhach that we weie comiifg, and when we arrived at Eberbach we surely felt safe from any further prosecution by the Americans, but soon after our ar- rival we became suspicious of a num- ber of strangers who cam . to Eber- bach, and I had reason to believe that the Americans were again after me. “I therefore took the necessary pre- cautions and counted upon the Ger- man government that it would see to it that I had all the proper protection of a political refugee in the country of my forefathers, and your honor knows well that I have shown my gratitude in many wavs to the people of Germany, and I only hope that this court will administer proper justice to these Americans who so unscrupu- lously violated the laws of this coun- try and international laws. Says Life Was Threatened. “The evidence I may give with reference to the attempt on my life is brief. I was host to a newly mar- ried couple. We had spent the after- noon at the Hotel Zur Krone at Eber- bach, and toward evening we were expecting some one else to join us. This party was to arrive here on the 6 o'clock train, and I suggested that we go down to the station in my car. We arrived at the station at about 6§ pm., and I was just getting ready to Jeave the driver's seat when the de- fendants stepped up to me. Naef, with a pistol in his right hand, which he pointed directly at my chest, saying: ‘Hands up! We've got you, Bergdoll. This {s the American police. “I knew the {ig was up. and, with » quick jerk with my right hand T knocked Naef’s pistol out of his<hand. rushed back to the steering wheel and started my car. A few seconds later I heard a shot and some ine in the rear of the car screamed. T looked around and saw that one of the girls in the car was shot in the hand and blood was flowing profusely there- from. A few yards_ from where - the hold-up took place I stopped the car, as we saw that a large crowd had as- sembled and that the criminals were in their nfidst.” As the slacker concluded his testi- mony, which at times he experienced great difficulty to give in German and often required the assistance of the interpreter, he turned in the direction of the two Americans, and. raising surprise, Bergdoll and his friends and | detectives made their appearance at midst of them, undoubtedly protected | by_armed members of the party. | Merely to antagonize us, a number | of toasts were drunk to the health | and long life and success of Bergdoll, | and the remarks that were passed. | sufficiently audible for us, were vile | and insulting enough to infuriate us. | In the afternoon many other wit- i nesses were heard, among them Eu- | gene Stecher, Bergdoll's chauffeur, | also @ draft evader, whose attitude | toward the defendants and toward ' America was equally as_denouncing | and arrogant as that of Bergdoll and { his friends. I may mention that the ! counsel for the defense in behalf of | Naef and Zimmer put forth a consci- | entious effort to trick the witnesses | in his cross-examination. And most of his attempts were greeted with | loud and boisterous hissing from the | audience,'and every imaginable epi- | thet in the German language was| hurled at him. (Copsright, 1922, by Press Publishing Co.) E 1l Tomorrow's installment will tell how the German court and the aud ence applauded the sentencing of the | two American sergeants, and will | show how Bergdoll is mow so much ' afraid of capture by Americann that he keeps moving from place to place, while the officials relentlessly pursue him. i GIVEN FIVE-YEAR TERM. ‘White Slaver Sentenced by Justice | McCoy—Other Cases.
