Ry the Associated Press. ORLANDO, Fla., December 3.—Lena M. T. Calrks, former West Palm Beach I postmistress, remained in the Orange county jail today following a verdict of “not” guilty because of insanity,” rendered late vesterday by the jury which had tried her on a charge of A. Miltimore, local restaurateur. in her room at a hotel here last August 1. Baxter H. Pat- terson, tried jointly with Miss Clarke, was acquitted without reservation. Clarke w: ordered returned to jail by Judge C. O. Andrews, un- til he could determine his future ac- tion. The woman cannot be commit- ted to the state insane asylum until commission has passed on her san- v. Selection of this commission would fall on Judge Andrews, and it is also within his province to set her free by virtue of the jury’s verdict. The defense based its case largely anity, s Miss Clarke taking the in her own behalf. She enticed [Miltimore to her room. she said. be- cause of her belief that he, as =a former employe of the post office, was the cause of a theft that culminated in her taking $32,000. The state con- tended that she stole the $32.000 and make it though Miltimore was responsible by placing evidence and then killing him. _Patterson came into the case by bringing Miss Clarke here from West Palm Beach the day of the killing. CLEVELAND, Ohio, December 3.— Vittoria Pisselli, who is said to have stabbed to death Daniel Kaber, wealthy Lakewood publisher two years ago, has been captured in Ripalimosani, Italy, according to word received here from two Cleveland de- tectives. He is being held there pend- ing word from the Italian ambassador at Washington. ‘Assistant County Prosecutor Walter 1. Krewson is en route today to-Wash- ington to present the facts to the ambassador. As there 1s no extradition treaty be- tween the United States and Italy for capital offenses, Pisselli probably will be tried in that country. I that event the detectives will remain there and testify against him. In four other instances recently, Italy has refused to send murderers back to this coun- try. Pisselll is the last of six alleged | conspirators in the Kaber murder plot to be arrested. According to an alleged confession of Salvatore Cala, who is serving a life term for impli- cation in_the plot, Pisselli stabbed |Kaber while Cala held the victim. They were to have been paid $5.000 by Mrs. Eva_Catherine Kaber, the slain man’s widow, who also was comvicted and sentenced to life imprisonment.
