By the Associated Press. POUGHKEEPSIE, N. Y., July 12— Daniel J. Gleason, referee in the Stillman divorce case, has handed down a decision admitting in evi- dence two letters offered by the at- torneya for the plaintiff and known a8 exhibits “B” and “C,* alleged to have been written by Fred Beauvais to Mra. Anne U. Stillman, the de- fendant. Exhibit “C" s understood to be the letter In which Beauvais is said to have threatened to kill any one who attempted to make love to Mra, Still- man, & nd contained the declaration, "{‘dl.m all yours and Guy's until the end.” Regarded Plaintiff Vietory. The ruling is regarded as an impor- tant victory for the plaintiff, since Referee Gleason in an earlier deci- sion had stricken out exhibit “C" with the stipulation that should si flclent additional evidence be intro. duced it might later be admitted. It is understood that the present decl- slon admits the letters only in so far a8 they relate to Mrs. Stillman and her infant son Guy, and excludes refer- ences to Beauvais as being father of the child. Referee Gleason's declslon upholds the contentions of the plaintiff in seven of nine points, again ruling out the testimony of Dr. Russell as to Mrs. Stillman's declaration concern- ing the paternity of Guy Stillman, and striking out any direct declaration which may have appeared in the record as to the paternity of the in- fant on the issue of illegitimacy. Phone Conversation Admitted. Among the evidence admltted is the testimony of Mrs. Percy Rockefelle: sister of Mr. Stillman, that Mrs. Still man over the telephone sald that her husband never came near her or would have anything to do with her. This was offered upon the issue of adultry only, and not upon that of llegitimacy. Exhibit twelve, a letter written by Beauvais to Mrs. Stillman in May, 1919, and offered by the plaintiff, both as grounds for divorce and as bearing upon the paternity of the infant Guy, is admitted into the veidence of the former count, but from it is ex- cluded any direct or indirect declara- tion by Beauvais as to the paternity of the child. Exhibits “13-A" and “13-B,” offered algo on both counts, are the subject of a similar decision. Exhibit “13-B" is the letter written by Beauvais to the defendant in February, 1919, the re- ceipt of which was acknowledged by Irene Kelley, then in the employ of the Stillmans at their Pleasantville es- tate. It was the “rolled oats and moc- assins” letter, and Referee Gleason ruled that it was admissible since testimony showed that Mrs. Stillman had acted upon it by sending for the oats as suggested by Beauvais and by keeping and cherishing the mocassins. Two other letters, exhibits 21 an 21-A, which were offered In evidence as standards of comparison bearing upon the handwriting of the co- spondent, Beauvais, also were mitted. They have, however, no direct bearing as testimony either upon Mrs. Stillman's conduct with Be upon the paternity of the ini y. John E. Mack, guardian ad litem for Guy Stillman, returned here from Yonkers, where he attended a confer- ence of Mrs. Stillman's attorneys.
