CLEVELAND, Ohio, March 21.—D. C. Westenhaver today played the dua role of federal judge and attorney for ! the defense, when John Duka, a farm- {er residing near Painsville, appeared in his court without counsel. Duka, who was charged with having in his possession property designed for the manfacture of intoxicants, was found not guilty by a federal jury. When Duka appeared without an at- torney. Federal Judge Westenh volunteered to represent the defend- if the district attorney is will- L. Eastman, representing the govern- ment, agreed. The jury was selected and the government presented its evidence. Duka was permitted to take the stand by his counsel and to be examined by the prosecution. The de- fense waived cross-examination. “I want for this defendant the same con- sideration that any man who appeared with a regularly employed attorney would receive. I move that the court direct a verdict of not guilty on the ground that the information does not set forth an offense under the statute,” Attorney Westenhaver said, address- ing himself as the court. “It is the court's opinlon that the information is not sufficiently plicit,” Judge Westenhaver ruled. sustain the motion. PLYMOUTH, England, March 21.— Lady Astor had an unpleasant en- counter here Saturday, when, as she was leaving her residence, a soldier halted her. made use of violent lan- guage and threatened to kill her. Realizing that a display of fear might be followed by an attack, Lady Astor sought for time and tried to get the man's name and address. Her tactics were 80 successful that the soldier started to run, with his questioner in close pursuit.
