The Charge of Murder Against Him Not Sustained. A jury in Criminal Court No. 1 shortly after 5 o'clock yesterday afternoon reported @ verdict of not guilty in the case of Wil- Mam Sauer, an enlisted man in the United States Marine Corps, tried under an in- sictment alleging the murder, February 12 last, of James Allen, a civilian. The jury was out about an hour. When the verdict had been recorded At- torney Turner, of counsel for defense, moved that Sauer be discharged from custody, and Justice Clabaugh so directed. Sauer ex- pressed his thanks to the jury, and then re- ceived warm greetings from a score of his comrades. A verdict of acquittal was generally ex- pected by those who followed the testi- mony closely. It was established that the defendant had always borne a most excel- lent record for peace and good order, and that the deceased was, in a certain sense. the aggressor in the difficulty which result- ed in Sauer striking Allen with his fist. The police of the city have been requested to locate and arrest Harry L. Haulter, white, twenty-four years old, who 1s miss- ing from St. Elizabeth’s Asylum.
