Controller Tracewell Decides That a Specific Appropriation Will ~ Be Necessary. fontroller Tracewell of the treasury has notified the District Commissioners that they are jyithout authority of law for the purchase “of the small chemical engine which it was proposed to locate in Cleve- land Park. As heretofore explained, the Commissioners were requested by the resi- dents of this suburb to take such action, and it being a question whether the plece of apparatus contemplated, costing about $700, could be purchased out of the appropria- tion designated in the current District ap- Propriation act “repairs of apparatus and new appliances,” the matter was referred by the Commissioners to the controller for his opinion. It was thought by the Commissioners that the word “appliances has a sufficiently Wide significance to admit of the purchase of this apparatus, it being explained by them that on some occasions in the past hose reels and other pieces of apparatus Were purchased out of this appropriation. But for the purchase of apparatus involv. ing large expenditures specitic appropria- tions have been made, forthe reason that the usual appropriations ‘have not been sufficiently Targe. How the Clause Must Be Read. The controller exptains, in his decision, that if the appropriation stood alone, or if it were made for the first time, it would, perhaps, be admissible to give the word “appliances” the meaning suggested by the Commissfoners, and to hold that the appro- priation so désignated is available for the Purchase of any new appliances for the ex- tinction of fire. “The clause, however, he holds, must be read in the light of the rest of the act, and of similar appropriations for the same objects. Since 1885 the appropria- tion acts, he states, have each year con- tained an appropriation for “repairs to ap- paratus, and new appliances,” and yet these same acts contain numerous specific appropriations for the purchase of new en- gines, trucks, etc. While it 1s true that in many cases the amount provided for the new apparatus is in excess of the appro- priation for repairs and appliances, it is equaily true, he says, that in many in- stances specific authority is given to pur- chase a hose carriage or a chemical, engine at a price well within the amount of that appropriation. Intention of Congres: “From this it would appear,” says the controller, “to have been the intention of Congress from the beginning to provide speciiically for any increase of the fire «e- partment in the way of new engines or ap- paratus, and this belief is strengthened by the fact that for several years past appro- priations for m engines, chemical en- wines, trucks and hose varriuges have been Placed by Congress under a specific sub- head of appropriation for ‘increase fire de- pertment,’ and appropriations for these ob- jects have been supplemented by specitic provision ‘for plates to house and man the additional apparatus. For the reasons given above, I am of the opinion, and so decide, that there 1s no authcrity for the purchase of the chemical engine to which you refer.” In view of the controller's decision, it is not improbable that the Commissioners will request the Senate to add to the pending District appropriation act the authority and funds necessary for the purchase of this piece of apparatus. ee PETITION OF SHEA HEIRS, Judge Cole Sustains the Administra- tor, E. A. Newman, Two weeks ago the heirs of Michael Shea, deceased. filed a petition im the Probate Court asking that letters of administration theretofore issued to Mr. Edward A. New- man, a member of the bar, be revoked on the gtoufd that the-same were issaéd with- in twenty days of the death of Michael Shea; also that they did not understand the purport of the wafvér-of citation which they filed, an@ further that the decedent Was not a resident of thé District of Co- lumbia. Mr. Newman, the administrator, through his counsel, R. Golden Donaldson, filed his also the affidavit of Mrs. Mary C. nd others in support thereof. ‘The case was set for today in order that the heirs should come into court and give tes- timony. Neither of them appeared, al- though Mr. Newman and the widow of de- cedent were present, with a number of wit- nesses in his behalf. The petitioners not being in court, and not having any testi- mony to offer, the court dismissed the peti- tions, thereby sustaining the letters of ad- ministration granted to Mr. Newman. After these petitions were dismissed, Wm. H. Shea, a nephew of one of the petitio Daniel F. Shea, through Lambert Baker, filed a petition, claiming that he entitled to letters of administration.
