Averill, an insurance agent, whose home is in®Philadelphia, was ar- rested yesterday afternoon by Detective Parham and held for his relatives, his pecu- liar actions inducing a suspicion of Insan- ity. He came here Thursday morning and registered at a hotel. He was later re- quired to seek accommodations at another hotel, on account of his conduct. ¥ester- day he returned to the hotel, and Detective Parham arrested him. Miss Madeline Averill, daughter of the unfortunate man, arrived here last night. Before her arrival the police received a message asking them to locate him. She told the police that her father had been under treatment in Philadelphia for mental trouble, and had been discharged from the hospital as cured. The Court of Appeals, in an opinion writ- ten by Mr. Justice Morris, in the case of the District of Columbia, plaintiff in error, against George Hazel, directs the Polic! Court to vacate the motion to quash the in- formation against Hazel and to grant a new trial in the case upon the facts. Hazel, a cabman, occupied a stand at the 6th street depot. He was ordered’ to va- cate the stand, and having refused to do so, was placed under arrest. His attorneys Messrs. D. W. Baker and John C, Gittings moved the Polfce Court to quash the infor- mation, because the police regulation in connection with which the arrest was made discriminated against him in favor of the Pennsylvania rallroad’s cab company. Upon the motion being granted, the District ap- pealed. It is held by the Court of Appeals that the regulation does not show discrimination upon its face, and that the matter is a question of fact to be determined by trial. —__.—__—_.
