A bill in equity for an injunction has been filed by Sullivan Forehand and Bax- ter E. Perry against Ellen F. Pres- sey. The court is asked to enjoin the de- fendants from receiving from the Treas- ury Department the sum of $66,907, appro- priated by Congress for the relief of one John C. Howe, deceased, in payment for the use by the United States of a certain device patented by Howe. It fs explained that while the Sectetary of the Treasury was directed to pay to the legal representative of Howe the amount stated, this was done because Howe was the holder of the legal title to the fund, and the complainants were but the holders of the beneficial or equitable interest there- in. The legal representative of Howe, it is claimed, is his administratrix, who, by virtue of her office, is entitled to receive all funds to which Howe was legally en- titled.
