Of course, nothing will be done in the case until the papers are received back from the leader of the band.” When asked if any precedents for the ar- rest of Professor Fanciulli existed, Col. Heywood replied in the affirmative. “Sev- eral times, when Professor Scala was lead- er of the band,” he said, “I was compelled to order him under arrest for precisely similar reasons as I understand exist in the case in which Professor Fanciulli is in- volved. The drill regulations call for a cer- tain number of steps to the minute in quick time. When Professor Scala had the band playing so that my command had to far exceed the stipulations of the regulations, I corsidered it proper to call for more ap- Propriate selections. When the leader re- fused to obey my orders, I very promptly ordered him under arrest. I took the view that when on parade the band is not at the head of the line to demonstrate its abil- ity to render classicai music, its presence there being solely to supply such appro- priate march music as might tend to make the appearance of the troops as creditabie as possible. The rendition of intricate and classical compositions should be reserved for concerts and like occasions.” During the conversation with the re- porter, Col. Heywood referred to the criti- cisms of Lieut. Draper that have been published since he ordered the arrest of Prof. Fanciulli. “I know Lieut.
