14 — DECISIONS HANDED DOWN Action in Several Cases by the United States Supreme Court. One Involving the Jurisdiction of a State Court Over Crime—Railroad Liability for Municipal Taxes. The title to the town site of the town of Flagstaff is involved in the case of Emma J. Gonzales vs. E. W. French et al., ap- pealed from the supreme court of the terr!- tory of Arizona to the Supreme Court of the United States. Mrs. Gonzales claimed the land under a pre-emption entry, but her claim was not sustained by the Arizona courts and the United States Supreme Court today affirmed this decision. Justice Harlan in an opinion for the court affirmed the decision of the Uniled States circuit court for the eastern dis- trict of Louisiana in the case of the New Orleans Water Works Company vs. the city of New Orleans, refusing to enjoin the city of New Orleans from granting to others than the water company the right to lay water pipes in the city. ‘The court has dismissed the case of the Chicago ard Northwestern Railway Com- pany vs. the city of Chicago on the ground of want of jurisdiction. The case is one in which the railroad company seeks to prevent the condemnation of ground for a ice White delivered the opinion of the court in the case of Pleasant Draper vs. the United States. This case involved the question of the jurisdiction of state courts of Montana over crime com- mitted by persons not Indians in Indian reservations in the state of Montana. Draper, who is a negro, was convicted in the United States circuit court for the Montana district of the murder of another negro in the Crow Indian reservation. He brought the case to the Supreme Court on a@ writ of error, alleging the want of juris- diction on the part of the federal court. The Supreme Court sustained this view of the case, reversed the decision of the cir- cult court and remanded the case for trans- fer to the state courts for prosecution. In an opinion by Justice Brown yester- day the Supreme Court affirmed the de- cision of the circuit court of the United States for the southern district of Georgia in the case of the Central Railroad and Banking Company vs. William A. Wright, controller general of the state of Georgia. The case involved the question of liability of railroad company for certain munictpal taxes along the line of the road. The court decided that a tax on the property was not a tax on the capital stock of the company, and upheld the constitutionality of the Georgia la In an opinion preme Court y relief asked by by Justice Gray the Su- erday refused to grant the the State of Nebraska in the case of that state against the Missouri Pacific Railway Company. The railway company declined to allow the erection of an elevator on land belonging to that cor- poration. Justice Gray, in the course of his opinion, said that the case involved no question of rates, but that, carefully an- alyzed, it appeared as a case in which a voluntary association of persons sought to secure for themselves certain privileges frem the railway company and to compel the donation of iand for elevator purposes. The United States Supreme Court yes- terday reversed the district court for the southern district of Iowa, in the case of A. A. Edgington, because the court had refused to accept evidence of the good character of the defendant, who was ac- cused of perjury in a pension case. “Whatever,” said Justice Shiras, in de- livering the opinion, “may have been s in some of the earlier cases, the decided weight of authority now is that good char- acter, when considered in connection with the other evidence in a case, may generate @ reasonable doubt.” —-. SAVING ERVE LIFE Some Facts Taken From the Annual Report of Superintendent Kimball. The report of Mr. Kimball, the general superintendent of the life saving service, for the year ended June 30 exhibits the most satisfactory results yet accomplished ly that service. Aithough the total num- ber of disasters was greater than in any Trior year, the percentage of lives and property lost was less. The next best record was that of ihe year IS. In that year the loss of life was one out of every 224 per- sons involved, and the loss of property 14 per cent of the amount imperiled, while during the iast year the loss was only one person out of 20, and 11 1-5 per cent of property. The number of disasters to documented sels within the scope of the service was involving 4,608 persons, of whom 4,505 were saved and thirteen lost. The esti- mated value of the vessels was $3,880,110, end of the cargoes, $3,546,380, aggregating @ total of $1 520. Of this amount $1,- 82,750 was The number of docu- lost. mented vessels totally lost was sixty-seven, There were alsé during the year 243 ualties to undocumented small ¢raft, sailboats, rowboats, etc. Of the 59% per- sons on board, 587 were saved and seven lost. The value of the property in those casualities is estimated at $119, of which $114,915 was saved The total number of shipwrecked persons succered at stations was 613. During the year the crews saved and 4 sisted to save 472 vessels, valued,with their cargoes, at $4,453,110. Of this number 31S were saved without outside assistance, aggregating, with their cargoes, a value of $977,495, with loss of only $11,713. In the remaining astanees the life saving crews assisted other agencies in saving property valued at 3, of $3,875,615 imperiled The cost of maintaining the service for the year was $1,401,805. Attention is invited to the inadequacy of the compensation of tie superintendents of life saving districts. An 775 out of a total annual compensation of 32,000 is recom- mended. The existing discrimination in the rates of wages paid the surfmen, a small minori- ty receiving $65 per month, while the ma- jority receive only $60, continues to be a Source of serious discontent and complaint. A uniform rate, it is said, is demanded by common fairness and the good of the ser- vice. The general superintendent recom- mends that such a rate be established. — gee Retalintion Suggested. Retaliation against the European coun- tries that seex to destroy American trade is suggested by United States Consul Gen- eral Max Judd at Vienna. He says that the Austrian glucose producers, finding their trust powerless to meet the rates asked by Americans, appealed to their gow ernment, and the latter has increased the duty on imported glucose from 7% to 18 florins per 100 kilos, to take effect Decem- ber 1. This is aimed directly at America. as the United States is the only country competing for this trade, and will shut us out from further sale of sirup. Mr. Judd gays: “It has been this way with other articles fer which Americans found a tor- ign market. If it was not a tariff meas- ure some other obstacles have crippled their efforts to maintain the trade.
