Judge Cole Li day—The Petition for a Prohibition lems to Arguments To- Against the Commissioners. The petition filed several days ago by the Metropolitan Railroad Ccmpany, praying for a writ of prohibition against the Dis- trict Commissiorers, was heard by Judge Cole today. Some time ago the Gecrgetown and Ten- leytown Rallroad Company, so Messrs. Nathaniel Wilson and A. S. Worthington, counsel for the petitioning company, claim ed, acked the Commissioners to abolish the separate tracks of the two roads where they coinc'de for ‘about twenty-four feet on 32d and P streets, and for about thir- teen feet and a half at 32d street and Dum- barton avenve, ard that the two railroads shall be compelled to use one set of tracks. ‘The Metropolitan company asserted that to grant the request of*the other road would necessitate the ,‘ntroduction of switches at the points in question. The experience of the Metropelitan road, it was also stated, In Ms use of the under- ground electrio’ system, has shown that switches have occasioned nearly all of the stoppages and damage suffered by the road. Then, too, the makirg of the switches, it was claimed, will necessitate the employ- ment of four switchmen at a large ex- perse. Patterson Found Guilty of Man- slaughter and Hookx Acquitted. After deliberating about an hour and a haif, the jury, in the case of Samuel Pat- terson and William Hooks, the young col- ored men charged with the murder of 1 Dede, also colored, in Pleasant alley Washington, the 34 of last January, re- turned a verdict, about 6 o'clock last even- ing, of manslaughter against Patterson. Hooks they declared to be not guilty of being an accessory, and he was accordingly released from custody. Messrs. and Jones, counsel for Pattersun, gave no- tice of a motion for a new trial, and the man was then remanded to jail’ to await sentence. Appler was out of the elty on the day charged, and his bartender, who was not on duty, was standing in front of the sa- loon when an intimate friend called upon him and asked for Hquor for a friend who = a peculiar one in light of the a Langston ! sick. The bartender had no means of getting in the bar, but he bad a bottle of liquor in his pocket, and this he gave to his friend. A few days later the friend gave him money for the liguor, When the police learned of this a warrant was issued, and the case reached court today.
