In the Supreme Court yesterday Justice Hiarlan handed down the opinion of the court in the case of Benj. Healy, involving the price of lands on alternafe sections with- {n railroad land grants, entered under the desert land laws. Healy paid $2.50 per acre for his land under the Revised Statutes and . brought suit to recover $1.25 per acre. The covrt held that the law providing a price of $2.50 per acre in such cases had not been repealed by the timber culture act, as was claimed, ind that $2.50 was under the law the correct charge on entries within land grants. In the cas#s between the Washing- ten and Idaho Railroad Company against the Cceur d’Alene Navigation and Railroad Cempany, involving the question of right of way at Wallace, Idaho, the court decided in favor of the Coeur d'Alene company, Justice Shiras deli s the opinion. gainst William Osborne t to unsurveyed land, sory title to the land, nages for right of way a railroad company. ntence of the United Sta circuit court for the southern district of New York, in the ¢ of the United Stat inst L. en goods” man, overruling t the statute of ‘ation was atfirmed. .
