District Attorney McFarlane Speaks in the Dana Libel Case. the New York Editor Should Be Removed to Washing- Reasons Why ton—Buell Case Cited. The argument on the application for a warrant of removal for Charles A. Dana of the New York Sun to this city, where he has been indicted for criminal libel on complaint of Mr. Frank B. Noyes, was resumed before Judge Addison Brown in the United States district court at New York yesterday afternoon. District Attorney MacFarlane began his argument for the government by saying that when he left the court room on Sat- urday evening he understood that, from what the counsel for the defense had said, they were in doubt as to whether there was such a place as the District of Columbia. “I have nothing to do with the result of i§ this application,” said he, “or What effect it may have on the Mberty of the press—whether it will result in drag- ging editors from Alaska or Portland to Washington for trial. I have nothing to do with any of these horrible possibilities. There is but one answer to make as to the Hberty of the press. That is, if editors will cease to use the columns of their pa- pers for criminai purposes and for gratify- ing spite against individuals, there will be no fear of them being tried in the Dis- trict of Columbia or anywhere else. The Power of Removal. a “Now. we are met with an objection which, if well taken, is conclusive. That is that neither under section 1014 of the Re- vised Statutes nor under any law whatever is there any power to remcve to the Dis- trict of Columbia offenders against its local or municipal laws apprehended in other districts of the United States. “I understood Mr. Root to admit in a sort of tentative way that under section 1014 offenders against the general laws of the United States—persons charged with hay- ing committed in the District of Columbia offenses which would be offenses against the laws of the United States wherever committed—might be apprehended under section 1014 and sent back to the District for trial, but in respect to the long list of crimes against the local or municipal law, whether it be robbery, arson, rape, bur- glary, libel or any of the long list of mis- demeanors, that there is no law whatsoever by which persons having committed those offenses in the District of Columbia may be apprehended outside of the District and sent back for trial, and it is very ex- traordinary that it has gone on for ninety- four years since the act of 1791 withovt finding out. . MacFarlane claimed that Congress has applied to the District of Columbia the legislation under the Constitution, so that fugitives from justice from every part of the Union who take refuge in the District of Columbia are surrendered upon the re- quisition from the executive of the state where the crime is alleged to have been committed. The construction of the law offered by the defense, he claimed, would leave no means in force for bringing back criminals to the District of Columbia who had once escaped from there. “For the past sixty years,” said Mr. Mac- “arlane, “as shown by the reported cases, section 1014 has been used as the basis for legal proceedings as applicable to the Dis- trict of Columbia against pessons appre- herded in other districts and charged with the commission of crime in that District. I submit that that is the practical interpreta- tion of this section.” Crimes Against the District. Several cases were cited in support of this ecrtention. Crimes against the District of Cclumbia, he argued, are necessarily crimes | against the United States, owing to the peculiarity of the local government of the District. ‘Our proposition here is,” said he, “that the circulation in any district, county or state of a newspaper published in another district, state or county containing a libel is a publication there in the district, state or county by circulation and may be prose- cuted there. We stand on the proposition that the circulation of any newspaper con- taining a libel that, having been a conse- quence of publication known to the editor at the time he composed this and prepared it, and it being of consequence known to him that it would be circulated in these ether districts makes it a separate and complete offense in every jurisdiction where that paper is circulated. Buell Brought to the District. Mr. MacFarlane quoted the libel suit of Zachary Chandler against Buell, and ob- served that Buell had been brought to the District of Columbia from Michigan and tried. He quoted the decision of Judge Dillen, who said that libel was an offense against the United States, and, therefore, an indictment might be found and the tugi- tive brought back. Speaking of the former attempt to get Mr, Dana to Washington, he called atten- tien to the fact that in all its essentials it wes entirely different from the present case. In that case Justice Blatchford had Gismissed the attachment against Mr. Dana because the warrant was issued by a court that could not give him a jury trial, which cannot be denied to any man under the Constitution. Mr. MacFarlane said that since that decision the Supreme Court of the District had been established, and there Mr. Dana could have, and would have if he asked it, a trial by jury. He dis:ursed in detail the technical ob- jections the defense made to the manner and form of the indictme: and offered en answer to each objection. MacFarlane had about thirty law books, reports of fed- eral and state courts at hand, and he made no statement without backing it up with precedent after prec In concluding Mr. ‘arlane said: “Your honor, I think we have made out fully a right to have this order granted. The only further suggestion, in closing my argument, is that I desire to make on this question of remgyal, notwithstanding all the cases submitted, if you hold that the District of Columbia does not come within section 1014, that you allow us an oppor- tunity to review that decision by granting the application and holding the defendant so that proceedings for reviewing may be taken. 1 should like to submit a brief.”” May Be a Long Delay.
