As a local NEWS paper and Advertising Medium tt has no competitor. =_————— ee It is desirable that the litigation over the title to part of the land improved in the recia- mation of the Potomac flats should be term: nated as speedily as possible, But the situation is not sach as to justify the proviso, attached by the House committee to the appropriation for continuing this work, that no part of the ap- propriation shall be expended until the suit has been tried m the lower court with ade- cision favorabie to the government, This action gives undue importance to the Kid- well claims, and attaches undue sig- nificance to a decision, which, on the principle that the impossible always happens, might come from the District court that there is some substance to these claims Every lawyer who has examined the subject for the government, whether a representative of the Department of Justice or a member of the Senate or House committee dealing with the question, has satisfied himself that there is no foundstion for this claim of title. It might be perfectly safe to make a continuation of the flats improvement dependent upon the defeat of the Kidwell cixim, but why should 1t be wade thus dependent? What logical con- nection is there between the suit and the ap- propriation? Wien the suit was authorized to settle this tite, it was provided by the same act that, if the claim of title was sustained, the Jand was tobe viewed as condemned by the gov- ernment as of a dste prior te the improvement, and damages were to be awarded by the same court to the Kidwell claimants representing the value of their land at the same date, before say improvements whatever had been made. And in excess of precantion Congress has pro- vided concerning varioug appropriations for flats reclamation that no part of the money shall be expended upon the land concerning the title to whieh there is dispute. So that the sijuation is this. © There} does not seem to be one chance in a hundred for shaking the title of the govern- ment toa foot of the ground. If, however, the Kidwell claim is sustained, the same court which susiains i+ must give damages to the claimants representing the value of the property before this improvement was begun, when the lots were water- lots and = confessediy almost worthless, ‘The proviso suggested by the House committee onght toact as a spur to hasten the speedy trial of the litigation, but the Poto- me improvement upon which so much has already been spent cught to le has completion without | any refer the law's delays and uncer- in Fespect to h, however, it It, is not, as Mir.
