Johnson, small colored boys, were brought before Judge Kimball to- day to have their eases disposed of. They were arrested about 5:30 o'clock Tuesday morning near 11th and G streets. The boys had a pack- age of cigars and some tobacco in their posses- sion and were found seated in a vestibule by Otticer MeCort. The judge, in trying to ascertain the ages of boys, was informed by one of them that he was born during the year of President Hayes’ inauguration. “That was in 1876.” said Mr. Dumont. remarked the judge. Mr. Dumont stili imagined he was correet, and he told the judge that he voted for Hayes im 1875. The argument ended when the judge said that the clections were held on even years and ‘the inaugurations on odd ones. Notice has been served on the Baltimore.and Ohio Railroad Company by the commissioners | of this county that better provision for the safety of the public must be made at Alpine and Kensington stations within thirty days. Either safety gates or watchmen are necded at these crossings to protect the heavy travel. ‘The bills filed recently with the commissioner by the registers of voters of this county asking additional compensation for posting liste of voters and for two trips to this place to obtain and return books have beon disallowed by the board. ‘The bills for posting notices were £12 for each register and for the trip to Rockville ¥5each Other billsfor room rent, stationery and postage were allowed. W. E. Fitzgerald, the Youngstown, Ohio, murderer. was executed at the penitentiary annex at Columbus last night. He was brought on to the scaffold at 12:03 a.m. and pronounced dead thirteen minutes afterward. He had nothing to say on the scaffold except to forgive his enemies. The crime for which Fitzgerald was executed was the killing of Officer W. F. Freed of Youngstown, Obio, May 15 last. He had com- mitted a bfirglary and Freed, with other ofi- cers, was in the act of making an arrest, when Fitzgerald opened fire. Freed received a fatal wound, and another officer was seriously wounded. Fitzgerald narrowly escaped lynch- ing at the time. He was sentenced to hang November 19, but Gov. Campbell granted a respite to this date to give the attorneys an op- portunity to carry the case to the supreme court on errors. The decision of the lower court was sustained in each instance, and the governor refused all further appeals for execu- tive clemency. The doomed man on Sunday night sought suicide by the use of morphine, but he was resuscitated. He also tried to kill himself last night by pushing a pencil into bis Dody at the heart. So far as can be learned Fitzgerald was born in Oneida, N Y., his parents dying when he was young, and he became fuentified with the criminal clases. He was sent to the peniten- tiary at Leavenworth, Kan , for five years for attempting to killan ofticer. After serving & portion of the time he escaped, and soon after iauded in the Jackson, Mich., prison under the name of Edward Haulou,’ where he served three years for larceny.
