Boynton, » member of the Rock “Iam no lawyer, but applying that modi- cum of common sense which any citizen may ciaim to possess, I should say that some of the Propositions made by these gentlemen are non- sensical. When it is asserted that the com- mission has no legal existence because Gen. Casey and Col. Robert are not appointed on the commission by the President the applicants for dismissal of the commis- tion's petition seem to lose sight of the fact that these two members of the commission were officers of the government already and that they are assigned to this duty, which is in line with other duties they are often called upon to perform. A MISSTATEMENT OF FACT. “As to the second point, that Congress has in the act devolved a judicial function upon the President in the adjudication of awards, it is a misstatement of the fact. The President has nothing to do with fixing the award by ap- praisement. The commission is authorized to mnake offers within a certain limit and those offers must have the approval of the President. There is nothing in the act authorizing the President to adjust the awards. “Again, it is complained that the owners of the land are deprived of the right to havea Jury determine the values. The Court in Gen- eral Term in a decision in relation to the con- demnation for the post office site held that in its exercise of the right of eminant domain no case arose between the United States and ® citizen as required the intervention of a jury. THE ACTION OF THE CoMMIssION. “They complain that because in the act Con- Gress has assumed to control the action of the commissioners designated to appraise the value of the property to be condemned and to restrict the rights of the ondents by limiting the amount which shall be llowed in the aggregate for the pay- ment of property embraced within the limits designated as a public park, that Congress has undertaken to acquire the prop- erty within the prescribed limits of the pro- posed Rock Creek Park without the consent of the owners and upon a compensation limited to a fixed sum ($1,200,000), regardless, alto- ether, of the adequacy of this sum t6 be Just compensation therefor. “Now the commission does not undertake to appraise values and Congress does not put any limit upon the appraisement under condemna- tion proceedings. The commission is merely authorized to make certain offers and Congress has limited the aggregate of these offers. If these are not accepted, condemnation proceed- ings are to be resorted to and the aggregate of the appr ents may be greater or less than the offers by the commission or the limit of what the commission is permitted to offer. Congress puts no limit on the valuation that may be placed upon the property under con- demnatior proceedings.” IN COURT THIS MORNING. The importance of the result of this campaign not only to the state but to the nation, is fully realized by the typical “Ohio man” ‘today, and all the artifices and devices known to modern politics will doubtless be ex- erted by both parties to win a favorable ver- dict from the peoplo in November next. SIGNIFICANCE OF THE CONUgpT. With the ciection of Gov. The renomination by the democrats of James E. Campbell fot another term is also predicted safely, warranted by the signs in the political tky, and the chief Contest for the next four months will be between McKinley and Camp- bell, the candidates for the other state offices being almost lost from sight in the great in- terest which centers in the leaders. ‘There were three conspicuous figures in to- day's convention, three men who, in public timation, towered far above their fellows, whose appearance singly or together was in- vanably the signal for applause, cheers and wildest salutations, yet, withal, men who bore their honors meckly and whose very modesty and reserve called forth increased public ap- plause. THREE REPRESENTATIVE MEX.
