Keeping a dis- orderly house was the charge against Eimer, and his counsel, Mr. Carrington, entered a plea of not guilty. During the hearing a col- ored witness claimed that he had been spoken to during the recess of the court by the de- fendant, who, he said, threatened to have him sent to the penitentiary if he gave evidence against him. SOME REMARKS ON CAPERS. Judge Miller aud that if the rules of the court had been observed the witness would have been inside court and not out on the pave- ment. He had taken every precaution against the operation of these “cappers” and wanted it distinctly understood that if any of them where the hand of the court can be put upon them they will be put away for the win- ter. The judge thought that if the lawyers wonld do their duty and keep these hangers-on from about their offices there would not be #0 much trouble. . The hearing of the case was resumed and it was shown that there were frequently large therings of colored persons in Eimer’s place rinking 5-cent whisky and playing cards. ‘The defendant testified in his own behalf and called several neighbors as witnesses, but their evidence could not meet the accusations of the officers and citizens. JUDGE MILLER ON SUCH SALOOXS. Judge Miller finally took a hand in the mat- ter and arraigned the character of Eimer's saloon in severe terms. Such places as that, the judge said, are calculated to demoralize a whole neighborhood. The imposition of a fine, he thought, would not remedy the evil, nor would it fit the offense. A fine of $500 would only amount to a high license and the defend- ant could then continue the same business. He concluded by imposing a xentence of three months in jail and a fine of €100. ‘The defendant was so movedjby the remarks ‘and ventence of the court that he cried like a child and promised to break up his business and never again sell liquor if the court would forgive him or impose only a fine.
