4 THE EVENING STAR. WASHINGTON: Aur Or Tie $ Supreme Court more sadly needs relief ‘Ran any other branch of the federal govern- ment. Forslong period the court has been overworked, and the attention of the bar in all the states has been directed to the question of what sort of relief it is best for Congress to edminister. Two bills are before the publio— the Dill of the Honse judiciary committee for a cireuitappellate courtand the substitute bill of the Senate judiciary committee. These bills may go into conference this week and out of the contest between the houses may arise the fequisite legislation or something approxi- mating such legislation. But the differences between the House and Senate are wide aud it ia believed that an agreement will not be reached readily. It is the duty of both todo everything possible to secure so desirable a re- sult. The principal feature of the House bill ia that which vests all original jurisdiction in the district courts and wakes of the enlarged cirenit court a sort of sub-Supreme Court. Another important feature is that by which the Supreme Court judges are relieved of duty on the cirewit courts. The new circuit-appeliate court is to consist of three judges and to bea final court of appeals ona large number of cases. An appeal lies from its decisions where novel or difficult questions or q of con- stitational construction are involved. The Sen- ate substitute leaves the cireuit court, with the exception of its size, very much as itis. It is to consist of three jndges—an addition of one new judge in each cireuit—the Supreme Court justices riding their circuits as at present. ‘Appeals are allowable from the present district and cireuit courts to the new court of appenis, ‘composed of a Supreme Court justice and two cirenit judges. The Supreme Court justices have given their approbation to the House Dill, which is less cumbersome and affords apparently more relief to that great tribunal It iwalso a more symmetrical measure, taken im eounection with the federal system as it exists. + Notwithstanding the opposition of some of the sonthern men the subtrensury plan was adopted by the Farmers’ Alliance, with the ad- ditional provision that the general government Jend money on land as well as agricultural prodnets. This implies that the alliance is {ally committed to that principle and proposes not to abandon it even for the tempting coali- tion offered by the democrats. The action sig- nifies that there ix more independence in the coazsels of the body than was looked for yester- @ay. The most that can be said for the amended bill is thatit is better than the original, which gave the railroad what it wanted in such manner as to deny all hope of relief to the public. += Senator Gorman in endeavoring in his specch yesterday to repel what he terms the partisan- ism and sectionalism of the elections bill and to hold the republicans responsible for sacrific- ing business legislation to « partisan measure, damages business interests unneccasarily him- self by grossly exaggerating the terrors of the financial situation, thus contributing to destroy public confidence, to excite popular apprehen- sion, and merely for the sake of a partisan Point helping to create the panic which he pic- tures. This is no time for ons whoappealsin the assumed behalf of business interests to play the alarmist. The Senator's own associates can hardly uphold him in the alarming language employed by him yesterday, virtually in the name of his party.
