In order to fully eccomplish this important purpose of those who have advocated the park bill it will only be necessary for the commission fixing the boundaries of the park to sce to it that at least astrip on each side of the creek is included clear to the District line, With these important advantages to be gained by the establishment of the park the decision of the Senate to accept the bili ae it stood, not- withstanding objectious to certain provisions, was unquestionably wise and is the decision of Washington. The only featare of their constitution made mandatory in the funda- meutal law was the structure of the Supreme Court—tLat only novel feature in the govern- ment of the Uuited States, All else, under the provision relating to “inferior courts,” was left in the discretion of Congress. The grent idea of a supreme tribun: the siigitest pos- wible orig wsdiction, to be the court of appeals for a federal nation from the decisions of lower federal courts and the supreme courts of the eeveral states has so worked itself out as well as the physical ability of the jus tices constituting the court would permit under the tremendous growth of the couutry in num- bers and we ‘The district and the circuit court and the Supreme Court have until within a few years been adequate or nearly adequate to the needs of the people. That they ure so now nobody pretends. The movement started years ago by Senator Davis, of Illinois. who had served on the supreme bench, and who was weil acquainted with the situation was taken up by the law associations und periodi- cals s been discussed in and out of Con- gress ever ¢. That movement conteni- plated no radical change in the existing system. It provided mmply for an iutermediate court of appeals and it met with much favor in high quarters, Indeed, the bill fathered by this eminent ex-judge passed the Senate but was opposed in the House. The principle of an intermediate appellate court was adopted how- ever at the beginning of the present session by the Judiciary Committce of the House and the measure passed the House. The Senate, which had on ted a bill nearly the = now changed the character of the bill ve Whereas the House measure ks vides for two new cireuit judges the Senate's provides for only one and makes the two cir- cuit judges and the Supreme Court justice for that cireuit an appellate court. The House bill divests the circuit court of all original jarisdiction. imposing upon the district court the sole jurisdiction of that nature. It makes the circuit court a court of appeals with the right to determine finally the less important cases, others going on appeal to the Supreme Court Inthe Senate biil appeals from the district to the circuit court are abolished and both are to be courts of original jurisdiction with right of appeal to the Supreme Court in xbly important cases and to the court of ap- peals im ail other caves, its decision to be final. Either plan would greatly relieve the Supreme Coxrt.
