This morning in the Court in General Term Mr. R. D. Mussey called the attention of the court to the difficulties attorneys sometimes encounter in regard to papers filed, which are sometimes taken from the clerk's office, re ceipted for and then mislaid outside of the office. He noted the fact that recentiy, through the clerk, he had been successful, after a six years’ search, in obtaining-papers in « case which should have been disposed of long since. The rulesasto law papers require copies, but in the equity cases no such rule applies. In view of the experience he and otbers had bad he submitted the following rule for the consideration of the court and asked that this or some such rule be passed: * All papers filed with the clerk in any cause shall be numbered consecutively in that cause in the docket and upon the papers themselves. A copy of all pleadings in any cause shall be served by the party filing the same upon the adverse party or his attorney, solicitor or proc- tor, if he has appeared. All written and printed exhibits produced on hearings or references before the auditor of the clerk or any master, commissioner or examiner thereof sball be, 80 far as practicable, securely attached to and incorporated with the report, deposition or the like. The papers filed in any cause shall re- main in the custody of the court and shall not he taken from the cour. house except by him (for the purpose of binding, copying or the like) or the justices, or for the transmission to the Supreme Court of the United States with « record when so ordered. A convenient room shall be provided for the examination, under the direction of the clerk, of the files by at- torpeys and others ; intere ted. DISTRICT Gov ERNMENT. A PROTEST AGAINST MR. HAZELTON'S APPOINTMENT. The Commissioners today received a letter from J. D. Croissant protesting against the ap- pointment of George C. Hazelton as attorne or the District. The letter asserte that Mr. Hazelton as attorney entered into a speculative agreement with Alonzo Sands to context the will of Timothy Sands, agreeing. so the h states, to defray all costs and charge noth for his labor if he faiied in the litigation, but to receive 15 per cent of the estate if he won The affidavit of William Mayse to the effect that he had heard Alouzo Sands say that his agree- ment with Mr. Hazelton was of the character described is filed with the letter. The case of McDevitt, the late permit clerk of the water department, who was dismissed for misconduct in office, is still being investi- gated, and not a day goes by but that some plumber calls upon Capt, Lusk to make some statement about the matter. Among several plumbers who called today was Mr. Perry of the firm of Perry & Suit. “His statement was that during the month of December he called upon McDevitt and deposited £10 to make « cut. When he called for the balance between the amount deposited and the cost of the re- pair, he says, he was informed that the repairs cost something over €8 and the difference be- tween that and the £10 originally deposited could not be paid until after the Commissioners approved the report. Miss McBride was charged with setting fire to house 515 Lith street June 30, 1887, and was con- victed in November last and sentenced, but numerous exceptions were taken during the tricl, on which the case will now be reviewod.
