Yesterday afternoon, in in the Police Court, Prosecuting Attorney Armes called Judge Miller's attention to the pending case of Ferdinand Lowenstein. charged with receiving the silverware stolen from the house of Mra. M and alleged to be the property of Mr. Malcolm Seaton, as heretofore published im Tax Stan. Mr. Shillington, for the defendant, argued the question of ownership. He claimed that the ownership of the property was not Properly laid in Mr. Seaton’sname, His left no will and there are three heirs, The Property was in Mrs. Munroe’s house and under her care, and he thought that the laid itr her name would have made a stronger ease. He referred to the young man, Frank Brainerd, who admitted 4 ae lied upon the stand. Counsel that the warrant was defective, as it ‘aia not follow the language of the law, and set out that Lowen- stein received the goods with intent to defraud the owner. REMARI OF TUDOR MILLER, The judge said that so far as an indictment ‘was concerned he agreed with counsel that it should set out that the defendant received the g00ds with intent to defrand the owner, but it was not necessary to set it out in a warrant of this kind. The defendant was Chas. Hoots, € nine-year-old boy, who lives at No. 1228 Dela- ware avenue southwest. The injured person is Wallace Cook, three-year-old boy, who lives with his aunt, Miss Mamie Regan, No, 1216 Delaware avenue. The assault occurred abo at ten days ago in Miss Regan's yard.
