To-day, in the court in General term, Justice Bradley delivered the opinion of the court in the case of Sarah Bradstreet agt. Geo. P. Brad- street, overruling the defendant's plea to the jurisdiction. The bill in this case was filed in October, 1887, for a divorce, and the defendant plead that he was not within the jurisdiction of the court, claiming Vermont as his residence, The court held that it residence meant domi- cile the defendant was within jurisdiction, and overruled the plea. Judge Montgomery rendered the opinion of the court in the case of Thos, E. Smithson agt. Mary Smithson, affirming the decree below, dismissing the bill. The court said the parties were married in 1858, and that the wife, after threatening to leave her home and being told she could leave if she wanted to, did leave with her son. The court held that this was not de- sertion in the meaning of the law, and affirmed the judgment below. pack He Took the Minister’s Hat. Rey. Sutton and walked quietly away with it, leaving his old slouch hat behind. Po- liceman Jordan captured Gaines and he was taken before Judge Miller this morning. The judge did not think ti Gaines intended to steal the hat and tined him $5 for disorderly conduct, ees A Repentant Countryman. “He struck the town too large. He ought to have gone by degrees.” That is what Judge Miller said of Harry Tyler, a resident of Charles county, Maryland, who paid his first visit to this city Saturday evening aud met three strangers who were willing to show him the town if he treated. He accepted their kind offer, treated, got drunk and was arrested by Policeman Boyce, and passed a sad night in the station house. In court this morning he said he was willing to give up all his money and walk home, @ distance of twenty-five miles, and be would not take another drink for one year if the judge would only let him go this time. The other five members of the joint committee, who favored the acceptance of the Schuyler bid, say that the contract was concluded on a cash basis and that the committee agreed to give negotiable notes running from oue to ten years in payment, and that they will carry the busi- ness out on that line, as the city council has in- structed them to make the cortract on the best terms obtainable.
