Here was an office more sacred, in some of its aspects, than any ther in the whole federal register. It involves the diguity and majesty of the tribunal of last resort for a nation of sixty millions of people—a place to which the final appeal of every citi- zen, in civil or criminal cases, in law or 4n equity, may be carried when any of bis con- ‘stitutional rights and privileges are at stake; and the seat which it was proposed to give Mr. Fuller 4s the highest in that tribunal, The gentleman to ‘De thus honored was a lawyer of repute and, to all outward appearance, a man of principle and ex- alted ambition. Indeed, it spoke volumes for the esteem in which he was held by his neighbors that {he recommendations for his appointment, repre senting every shade of political faith, were carried to the White House by a republican Senator, who algo took the responsibility of citing bis col- Ieague’s opinions as cotneiding with his own. After hanging fire for two months, the nomination has been reported back to tne Senate without recommendation, the republican majority on the com.nittee refusing to Join ina favorable report,and the democratic minority unwilling to have an unfa- Yorable one made, This 1s a wrong both tothe candidate and tothe public. If Mr. Fuller 1s un- worthy to be Chief Justice it 1s the duty of all members of the committee who think so to speak their minds freely. If he is not unworthy, fairaess to the candidate requires that he should not be al Jowed to ascend the bench with a cloud resting on his good name, even by indirection. The present situation, with all the injustice involved in It, 1s in large measure traceable to the star cuamber system of conducting executive business, Had the sessions of the Senate all been open, the report of ‘the committee setting forth the facts on which the majority rest their refusal to make any recom- mendation, would bave been the property of the public, and every citizen would have had a chance to study the case and pass judgment on it for bim- self. Moreover, in open sessions the committee ‘Would have been subject to frequent demands for areport, which it would hav: every consideration of expediency, to furnish, or else to give a reason for its long delay.
