This morning the trial was resumed and Judge Montgomery charged the Jury that all killing was Justiflabie, excusable or felonious homicide, and the latter Was either murder or manslaughter, He recited the theories of the prosecution aud the defense, one clatming that the shooting was uu~ lawrul, and the ouher that it was justifiable, and that the fatal shot was fired accidentally.
