CITY AND DISTRICT. THE FISHERIES TREATY. Reports of the Majority and Minority of the Senate Committee, ‘The Senate has removed the injunction of se- erecy from the report of the comunittee on foreign relations upon the fisheries treaty. The majority Of the committee states “that It has had the said ‘treaty under careful and deliberate con- aan and that it returns herewith a resolu. tion tn the ordinary form for its ratification, with the expression of its opinion that sald resolution ought not to be adopted.” The report criticizes the President for not putting into execution the act of March 2, 1887, to protect the rights of Anter- his action tm appotnt- ers without the advice It ts not difficult to see, in_evil times, when the United States may be under ¢ Of foreign and adverse interests, edure might result in Interests and even at and people. ‘The document Senate by the Prest- dent as me of these negotiations may, it is thought, well illustrate the dangers of such’ mnethods, ‘The majority devotes twenty-odd pages to tue dexatied discussion. of ‘the provisions of the Uvaty, but summarizes its Mndiags and its opinions briefly at the end. It makes the Zollow- Jng comment: “The committee thinks it due the Senate tg state that, contrary (as it believes) to the untvebsal previous practice of the executive in connection with t sideration of treaties when the Senate has asked for all the papers and information in detail concerning the progress of the negotiations, the executive has not thought it for the ‘public Interest In this Instance to com- Inupicate all such papers and such detallea tnfor- mation to the Senate, althouzh the Senate re- questea if, and ft was stated In reply to the reso. Tution of "request that the deliberations of the pienipotentiaries were in confidence, and that Only results should be announced, and’ such other Matters as the joint protocolists should sign under ‘the direction of the pienipotentiaries."* ‘THE MAJOKITY'S SUMMARY AND CONCLUSION. ‘The following 1 the majority's summary and conclusion: “The United States recognize as British territory and renounce forever all claim of independent right in the great bays along the British North American coasts named in’ the teaty, and adinit that ail such bays form a partot and are within British territorial sovereignty and Jurisdiction, new areas of delimination de Seribed in the treaty greatly increases the danger Of our fsuermen ‘unintentionally invading pro- hibited Waters, and thereby exposing them to Seures and penalties, The treaty is a complete ‘Surrender of aby claim of a right now existing for Yeswis of the United States engaged In fishing any- Where on the high seas, and even having a com- mercial also, to enter any port of British orth America for any commercial purposes what ever, and puts in the place of these clear rights which, in respect of British fishing vessels, exist In the United States to the fullest extent, greatly re- stricted and conditional rights as arising solely from a present grant of Great Britain. In the face of all this t leaves Britis North American fishin ‘vessels possessed of all commercial rights inal the ports and waters of the United States. It pro- Vides that general, and even then much limited, cotumereial rights'and rights of transhipment, a3 ientioned In article fifteen, shall be obtained only at the price of exempting all Canadian fishery pro- ducts from our custom duties.” ‘THE MINORITY OF THE COMMITTER hold that in accepting the paper sent tothe Senate by the President as a treaty, and by referring the same to its committee, the Senate have virtually Waived any informality, if there is any, in the ne- otfation and signing of the instrument, and the undersigned concetve that the whole duty of the committee was to consider and report upon the ments of the treaty. The minority then enter upon a historical and argumentative constd- efation of the fishery question, and say: “We seem now to have reached a point where we must seek'to allay the growing bitterness of these dif- Terences by a friendly, sincere, and mutuaily re ‘Spectful consideration ‘of the ‘positions assumed by each government, or else we must enforce our Views by Vigorous measures of retallation. This treaty does not bind us to advance no claim here- after to increased commercial privileges in favor Of our fishermen. ‘The minority finds an impor- lant precedent for this treaty in the arrangement Offered by Mr. Seward in 166 to the British gov- €rament. The minority do not find it necessary to answer in detail the various objections urged in committee by the Senators opposed to the ratl- Reation of this treaty, because no amendment was offered toindicate that the treaty could be so improved a3 to gain the support of any member of the majority of the committee.” In conclusion the minority say: “The treaty 1s a just and fair settlement. There 18 no fault inthe manner of its negotiations, and the President has not in any ‘Way exceeded bis constitutional powers or with- heid any courtesy due the Senate in respect of the agents selected by him to conduct the negotiations ‘oF im the time or place of negoUlating or conclud- ing the treaty.” —— Base Ball Yesterday.
