Burke, were charged by Officer Costello with cruelty to animals, It ing all ‘that they overdrove a horse which Rutherford had hired at Russell's livery stable, Mr. Russell testi- fed that he hired Rutherford the horse at 7 o’clock in the morning to take his wife out in the country, Later in the morning he learned that the animal was being driven about the city. When the horse was brought 1 at night he had lost one shoe and another Was loose, and the vehicle was broken. Dr. Barnes testified that he saw four men in the buggy at one time, and the horse being driven fast. Chas. A. Walter testified that the defendants were intoxicated. Rutherford testified that he did not treat the animal badly, and said that if the vehicle was broken he was willing to pay for it. Ruther- ford and Burke were fined §20 each.
