THE EVENING STAR The Evening star has a regular, permanent bons fide daily cireulation more than treble that of any other daily paper pub- ton, and equal to that of Asa reason why a great fuss is being made ever the trial by a Mexican court of an Amer- feaa citizen for an offence which his friends ciaim was committed on American soil, (but whieh elaim the Mexicans do not admit,) while no notice is taken of the action of an English court in alike case, it is given out asan expla- nation that the two cases are not precisely par- allel, inasmuch asthe first isa criminal pros ecution, while the latter fs a civil action, for dasaages only. This is true. The distinction urged iles, however, in the will of the plaintiff im the case or ina difference in the statutory penalties in the two countries for the same offence, and ot in the nature of the cases them- seives. It does not touch the essential prineiple involved. The broad, clear fact remains that the courts of two foreign countries have, on complaint of the Injured party, taken Jurisdle- tion and tried an American citizen for the offence of libel. These libels were published not in the country where the complaint was made and the trial had, but in the United States, though under somewhat different cir. cumstances. In the first case the libel was ebarged to have been printed and published in New York, and circulated in England through the malis, and possibly by other common car- Tiers. In the second it was printed and pub- lished In El Paso, within the United States, and circulated in Mexico, as the authorities of that country allege, and aver that they can satisfac- torily prove, by the direct act of the detendant,— himself domiciled at the time inMexico,—though he first published :t in that country, and after- wards retracted it. But, however that may be, 1m both cases the detendant was deciared guilty, and judgment given accordingly. The latter ease Is the “outrage” which the Jingoes who ‘want war with Mexico are howling about. The other they coaveniently ignore. How far the relative strength of the two countries named influences their views of the matter will always remain an open question. —— 2 A few years ago 3ir. Samuel Wood, a New Yori bachelor, died and left his entire fortune, amounting to more than $600,000, to the ‘ounding of a musical conservavory or college | im that city.
