B. Benham against W. H. Porter, N. H. Miller, and others, Judge James delivered the opinion of the court, reversing the judgment below and remunding the case lor a new trial. This case grows out of the caligraph controversy on a charge of lar- ceny, forgery, trespass, &c., made inst the plaintiff, who was acquitted. The plaintiff sued ior damages and obtalned $2,500 damages, for which an appeal was taken. The court eld that there was not sufficient evidence to ely proceedings against, Messrs, Miller and Hitch- cock, and remanded the case tor proceedings as regards Porter.
