Unable to Agree. THE JURY IN THE WHITAKER CASE DIs- CHARGED, On the adjournment of the Criminal Court yesterday, Judge MacArthur sent word to the jury which retired Wednesday with the case of ‘Mr. G. A. Whitaker, charged with presenting false bills to the bureau of medicine and sur- gery, Navy department, that he would come down to the court-house in the evening. Judge MacArthur returned to the court-house at o'clock, The jury was brought in, and the Clerk asked f they had agreed and’ was ine formed that they had not. foreman stated there was no prospeet of agreement, and further, that one of the jurors was sick. The jurors, before | leaving the Jury-room, signed a paper that they would hot divulge any of thelr proceedings. eS Death of John Kirkwood. ‘From the Cleveland Piaindealer, Jan. 17. John Kirkwood, an old and well known citi- zen of Cleveland, died at 4:20 p.m. yesterday at his home, No. 17 Osborne street, aged 75 years. He was formerly the proprietor of the Kirk- wood house In Washington and from 1865 to to1872 managed the Weddell house. Dr. NEWMAN AND THE METROPOLITAN Dr. J.P. Newman, whois now in the clty, faformed Messrs. Emery, Charlton, Henkle, Talmage and Fowler, a committee rep- resenting the Metropolitan M. He expressed his willingness to return to the pulpit of the Metropolitan if it pleased the bishops to send him there. ee SuppeN DEATH oF A Lapy.—Miss Mary N. Wailes, daughter of the late Stephen Wailes, died stddenly last evening at her home, 221 Ist st.n.e. Miss Wailes had been an invalid for aloug time, suffering with consumption. She appeared as well as usual, however, last evening. While walking trom one room to another she fell to the floor ana expired in a few minutes. Mor- sell and others conveyed to James Towles (father of complainants) and Joseph Grimes the property for the Shiloh Baptist church; that Grimes during the late war was beyond the lines of the union armies, and the United States attorney, for the church, filed asuit in which James Towles was dec! a the sole trustee, and he advanced large sums of money for the erec- tion of the church; that under the authority of the church, James Towles conveyed the Prop; erty to H. 0.
