There was considerable discussion as to how his place could be filled, there being no pro- visions of the constitution’ or the code whieh created a vacancy in the case of a judge fotng mad. The difficulty was apparently solv: by the resignation of the judge written, as every one supposed, during 4 lucid interval, The governor appointed Walter Levy judge in Clough’s place. Clough, however, hus since improved, and is now sane. Mrs. testi- fies that the Judge was insane when he signed the resignation, and he confirms the statement by averring that he has no recoliectian of the circumstance, He is, therefore, still Judge, and there was no vacancy for Gov. Stoneman to fill, Walter Levy is not, and never was, judge of perior court, and, unless the tawyers should decide that his acts as such when he be- Saba een or oe —- incumbent of e office are valid, Proceedings taken before him are null and vok ADRIFT IN THE LAKE.
