THE DELAY IN CARRYING OUT AIS SENTENCE EXPLAINED. ‘The fact that Benjamin F. Bigelow was sent to the state prison at Concord, N. H., last Fri- day, nearly two years after he had been con- Vieted of embezzlement and sentenced by Judge Wylie, in the Criminal Court here, has caused some comment. The question hereto fore frequently asked, why such delay in carry- ‘out the sentence, is thus explained: Upon ints made by his counsel the case went to the General Term, which. on June 22d, 1884, gave @deciston ailirming the Judgment below. ‘The Sentence was imprisonment at hard labor in ‘the Concord, New Hampshire, state prison, with which the government had a contract at the time. Shortly afterwards the contract ex- Pired, and the contractors working the prison rs there having failed,a law was passed by the New Hampshire legislature whieh, it was ¢laimed by many here, made the prison one of solitary confinement, and therefore Bigelow could not be sent to it. It was also claimed by some of Bigelow's triends that the sentence was without authonty of law, as it prescribed labor. These questions were recently acted upon’ by the Attorney General, whe decided ‘hat the sentence could be carried out by send- ing the prisoner to Concord, and_he left on Fri- day. as stated in TUESTAR Since his Incar- ceration In jail he has been sick, but had recov- ered, and was in excellent health when he left.
