They allege that they have no authority in the matter; that under the law the entire control of the aqueduct water supply Is placed in the office of the chief of engineers; that their responsiblity is simply ‘the responsibility of vigilance; that if the water supply was recking with polson the Commissioners could not lawfully spend one doliar of the calamity fund upon it; that “as soon as their attention was called to the matter” they did all they could within the limits of their power and promptly laid the matter before the proper officials; and finally that “confusion as to the responsibility of the District authorities has grown out of the dual official employment of Maj. Lydecker, who, while being Engineer Commissioner ot the Di trict, Isat the same time the engineer officer detailed by the Secretary of War to take charge Of the aqueduct.” Giving the Commissioners all the benefit of their explanation they are entitled to, it will occur to the reader, Ist: That in this ease they did not exercise even the ordinary “vigilance” which they admit to be their duty. It was only after “their attention was called to the matter” in decidedly vigorous terms by the press that they gave any consideration to the condition of the water supply at the conduit head, and even then they were at first disposed to poh poh the whole complaint and deny that there was any danger of pollu tien to the aqueduct water from the filthy canal water reaching the conduit mouth through the lenky waste weir.
