THE CHARGE AGAINST POLICE OFFICER SHANKS. ‘The police tril board has Investigated. the charges against OMcer Benjamin F, Shanks, of the sixth precinct, charged with having used unnces- sary violence in arresting Thomas Sutton on the 14th instant. ‘The evidence for the prosecution was that the officer had struck Sutton, who Was drunk. with his club, and knocked him down. KARCHER AREAIGNED AND SENT TO JAIL TO BE TRIED ON AN INDICTMENT FOR MURDER. | To-day in the Criminal Court Louls Karcher, ebarged with the murder of John W. Grimes on | the night of the 27th of March last, was called for arraignment. The accused was accompanied by his counsel, Nir. T. J. Mackey. and he pleaded not gulity. Karcher lived on 7th street southeast, and the homicide occured in the bedgoom of his wife, And Was witnessed. only by her, add she cannot Dé witness against her husband. He submitted that the indictment having been found, he should not now be at lange. Suid that the grand jury did not fix the grade of the offense, and that, under the evi. dence, were the accused a howling thantac, it would De the duty of the grand Jury to tind an indictment for murder. He submitted that If the prisoner was required to give larger ball it might result in nis iinprisonment, and it would be perfectly safe for ‘him to remain’ on his present bail. REMARKS OF JUDGE WYLIE. The court (Judge Wylle) sald that the case was not now in the same condition as when he took Dall. The grand Jury could have indicted for man- | slaughter, but tt had not done so, and had found an indictment for murder. When a man kills his wife's Paramour in the act of adultery he would ordi- harily admit the slayer to bail. But ithad not been so in this case, and au indictment for mur. der had been found. " The case of a man finding a paramour of his wife in his bed was not always | such ap one that the act was excusable. There | may be circumstances which may make the act murder, such as the husband having the knowl edge of the acts of the party, aud permitting the party to fall Into the trap. "He did not mean to | say that this was the cage here, but Che grand jury | had examined the witnesses, and found an indict. ment for murder, and he could not therefore say that the case Was Dallable. He therefore ordered Karcher into custody. Mr. Mackey asked for a speedy trial, and the district attorney said that he Would give him a trial at this term. An Old-Fashioned Elopement. West, the fourth delegate, a Blaine man, against General Jonn Beatty, a Sherman man, resulted as follows: 300 Votes against 257, and West was declared elected.
