Major Nickerson has turned up as a letter writer to the New York Heraid from Thorald, Canada, where he has resided since June 8th, under the assumed name of E. H. Burdick. He says in his communication that he has been unjustly treated by Adjuant General Drum, whom he charges with keeping a literary bureau to magnify himself and punish his enemies. He goes at Tength into the question of disobedience to onlers, and argues that he is guiltless In this respect. “He says he 1s no serter, and that as soon as his health will permit he will return to Washington, 1f General Drum will call off the detectives who are shadowing him, so that he can escape the ignominy of arrest. The Was about (75. CIVIL RIGHTS, The Act Unconstituvional. DECISION OF THE U.S SUPREME COURT. With but one dissenting votce, that of Justice Harlan, the U. S. Supreme Court decided to-day that the Civil Rights act is unconstitutional and vold. Justice Bradley, who read the opinion of the court, took the ground that thie scope of the 13th and 11th amendments did not extend to the social privileges sought to be guaranted by the lests- lation in question, Justice Harlan sald that under ordinary cireumstances he would be slow to oppose his individual judgment to his colleagues, but this decision defeated what the people intended to seeure and supposed that they had secured, and hence he must dissent from the opinion. He had not had time to formulate his views, however, and would now therefore merely amounce bis dissent. Quite a number of prominent lawyers were within the bar to listen to the opinion, including the At- torney General and Senators Bayard and Garland.
