THE DEFENSE WILL NOT “ARGUE THEIR PRAYERS. In the star route trial, after the recess, Mr. Davidge announced that the counsel for defense had decided not to make any argument upon their Prayers, but submit them as they stood. Mr. Bliss said the government proposed to call atten- tion to some of the prayers of the defense. ‘There was some debate as to whether the gov- ernment had a right to arzue om the prayers sub- mitted by the defense without argument. Mr. Bliss finally submitted without further argument. Mr. Wilson for Mr. Brady, and Mr. Henkle for Mr. Vaile, offered some supplementury prayers. Mr. Merrick sald he wanted it understood that the argument on the prayers had not been tormi- nated by agreement, but the defense had declined to argue, and hence the government was stopped. The court referred to certain prayers of the de- fense, and said he would like to hear from the government whether they claimed that certain acts chargea as frauduient were done in pursu- ance of the conspiracy. Times. The universal opinion expressed by lawyers here is that the speech was one of the most sym- metrical, complete and convincing analyses of a caseever heard in the Districtcourts. The jury was to-day allowed to go free until Tuesday,asthe court does not regard it necessary that the jurymen should hear the arguments on the prayers on Monday. There is, perhaps, no reason for the policivude on the ‘pars of (many Pponte lest the jurymen sho three fore they will fe calle upon to render a ver ict. The only reason for a suspicion so unjust to honest jurymen 1s, perhaps, the extreme confi- dence on the part of the star route people that thelr friends, the defendants, will all be acquitted.
