After recess, in the Hamilton murder trial, Geo. Smith was sworn, but bis testimony was unim- portant, Sarah White testified that on the night of the homicide she looked out of her window and saw three men (Hamilton and Mockaboy being two of them) on her step; they were there an hour; when Hill came around something was satd to Hill as to whether he meant what he said. Hill said he did. Hamilton sald, “Take {t back,” George said he wouldn't, for he was a gentleman. Hamilton then shot him, and they left. Charlotte Waite and Lucy Hart also testified as to the shooting. es The Star Route Trial. PROCEEDINGS AFTER RECESS. After the recess Judge Wylle asked Mr. Bliss to Testate what he proposed to prove by the wit- ness. Mr. Bliss sald they expected to prove that this ‘witness followed Rerdell, and saw bita actually go into Dorsey’s office about ten o'clock. Mr. Ingersoll asked the government to state whether they had not known of this evidence be- fore the case for the government closed. Mr, Bliss sald they had known {t was possible to show that Rerdell had gone to this office. Judge Wyile, after reterring to Rerdell’s testt- mony, sald he thought {t was plain that Rerdell had get the boak after he went to Dorsey's, This evidence, he thought, tended to show that he got {ton the morning before going to Dorsey's. He thought the "evidence offered" tended to make out «=a different state of facts than those testified to by Rerdell. ‘This evidence could only tend to prove, perhaps, that Torrey was mistaken tn saying he had not | seen Rerdell. As the matter stood the court would leave the conflicting testimony to the Jury to de- cide, and exclude this evidence. James W. Donelly was called to show that Mr. Dorsey had ratd him for work since he had copied the books for Rerdell, thus showing that he con- sidered the debt heowed Dorsey as having been settled by the work hehad previously done, though Dorsey denied having employed him.
