CAPT. VERNON REQUESTS AN INVESTIGATION, This morning Capt. C. R. Vernon, of the Metro- politan police, after reading an article in this moraing’s Republican, headed “Detective Devil- try,” Immediately addressed a note to the District Commissioners, in which he says: “In reference to the inclosed charge, published inthis morning’s Republican newspaper of this city, made by one John E. Smith, I have the honor to réquest at your hands the most searching in- quiry and Investigation into that matter, as well as any other charges or allegations affecting my charucter elther as a man or an officer of the po- lice department, without limit to time, place or any other circumstances.” It ts understood that Lieut. Arnold will make a similar request. ‘THE CHARGES AS PUBLISHED. The Republican, in reference tothe letter of John E. Captain Vernon is charged with having received a plain gold ring from a monte man, which he kept until the cliizens’ cormmittee began investigating, and ve received a gold watch and chain from the monte men, and a beautiful watch seal from Brockway, the forger.” —* ——————— Wasting Potomac Water. CASES IN THE POLICE COURT. In the Police Court this morning Mr. PT. Kinsbury, of No. 1406 T street, was charged with wasting water in a closet in his house. Inspector Jno. M. Shomo, of the water department, testified that there was a defect in the plumbing arrange- ments In the closet, and the water constantly ran in asteady stream. The defendant claimed that he was advised at the health office that it was necessary for sanitary purposes to have the water run in the closets. Judge Snell replied that the health office has nothing to do with this question. ‘The defendant was fined Mr. P. W. Browning was charged with wastl water in @ house at the corner of 84 street an Missouri avenue, and Mr. John Sherman was charged with wasting Potomac water in house No. 646 B street southwest. Inspector Shomo stated to a Star reporter this morning that residents of the neighborhood of M street and other high points have notifiea the au- thorities that since the recent prosecutions for wasting water they can get considerable more water than they were getting previous to the rosecutions. ‘These people are justifiably anx- ous Mo have all violators of this ordinance brought before the court. Meeting after meeting has been called, with little or no response from the people. ‘The clerey seem indifferent to the call, and the churches make no effort to attend. Meanwhile the oor are suffering, and the few ladies who are try- ing to meet their wants haye exhausted their funds, and are overwhelmed with leations ‘The Proposed New Gas Company. REPORT OF THE MINORITY OF THE HOUSE COMMITTEE AGAINST THE MEASURE. ‘The views of the minority of the House com- matttee on the District of Columbia on the bill to incorporate a new gas company in the District are quite lengthy. It sets forth that the Washington Gas company has to-day capital and plant suffi- cient to supply twice the quantity of gas required by the city of Washington, and to permit a com- peting company to enter in the business would be simply to increase the capital without increasing the business. The report shows that competing companies have been begun in the following cities, and soon combined or were absorbed: New Orleans, Charleston, 8.C., eee Louis, Chicago, Buffalo, Detroit York city, Providence, ‘Broo! Newburgh, N.Y. Tventon, 3 isburg, Lan- caster, Pa., and Buitimore, Md. In all these cites gag is sold ata higher rate than in Washington elty. The report says: Ww any extsting monopoly be un- controlled, either by competition or’ legistation, there would be grave danger that injustice might be done the public by charging exorbitant pices for an article of prime necessity; but happily, m this caxe, no fear need exist, for by existh laws the Washington Gas Light com, is as absolutely under control of Congress, as far as the prices are concerned, a8 13 the water-works of this city. If there is acity in the country where competition {3 not needed it is here, where Con- gress fixes the price and qaality; and if the price is not low enougi Congress has only to say how low it shall be. Congress has exercised this authority several times, namely, June 30, 1861; July 11, 1862; January 20, 1865 ; April 10, 1869; June 23, 1874. ‘These reductions were general, to the government and people alike. Since 1874 the com- pany have made several reductions, voluntarily, and Instead of useless warfare and loss, why does not Congress exercise. this authority again, and Compel the existing company to sell ‘thelr gas as low as tt is offered by the pro; ‘opposition, and prevent the tearing up and defacement of Your streets? Gas companies, by their nature, cannot seek business one foot beyond their pipes, and it ap- pears too plain to admit of argument that when ‘ongress has established an agreement with a corporation to grant It certain privileges and im- munities, and have thereby induced the corpora- ton to invest its means for a specific purpose, and that, too, in such a shape that the corporation cannot resume its capital again for some other purpose, even though these immunities be in- ringed and these pusitenes contracted; that Congress: 1s bound by every principle of justice and equity to not oniy retrain trom impairing by Hs own uct, but to prevent any action of another from Impairing in any degree these original rights or grants which constituted the strongest induce- ment for the corporation to invest its capital, es- pecially in this case, where Congress has the right to fix a fair price. Si ‘Two sets of cas pipes in the streets are a nul- sance, and lead to conflict of opinion as to which set of pipes are leaking: the leaks therefore go Uunchecxéd,endangering the health and comfort of the dL OF both parties tear up the streets searching for the leaks. When there 1s but one company there is no doubt as to who 18 responsi- ble, and but one excavation Js necessary to find one leak. The laying of gas mats under stdewlks should be positively prohibited, for gas goes in the direc- ‘ton of the ieast resistance, and if pipes are lald under the sidewalks, when leaks take place the gas soon finds it wiy into cellars and vaults, tuereby endangering the health and sometimes the tives of the Inhabitants by explosions. Be- sides, when gas mains are laid under sidewalks the sensible and insensible leaks of gas come in contact with the roots of the shade trees and kill them, and no matter how carefully gas mains are laid the vrees will suffer if they are too near them. Before the asphalt and other roadways were lald down the Washington gas company, in the most caretul manner and at great expense, relald and stopped any leaks in their pipes in the streets, The amount of leakage has thereby been reduced tothe minimum. When the new sidewalks were recently latd on Pennsylvania avenue and other streets the company was required by the Commis- sloners to renew their service pipes for house sup- Ply to all persons using gas, and were further Tequired to lay such service pipes to points and Places where gas may be needed tn the future. ‘or what purpose was this precaution taken, and why this requirement by the District, Commission- ers? It was that the expensive and smooth streets and sidewalks should rot be torn up by doing such work again. If the new company be admit- ted, at least 150 miles of main trenches will have tobedug in the streets,and if they get half thecon- Sumers and half the lamps, 9,000 or 10,000 lateral trenches Will have to be dug, creating & nuisance for many years to come. Streets and sidewalks such as are in Washing- ton cannot be taken up and put down again to be or look the same as before. In proof of this It 18 only necessary to look at the defacement and ugly Scars where the surface has been disturbed by ex- cavations or caving in of sewers, and where the pavement was put down again. No skill can, it 1s, asserted, prevent more or less settling of the dis- turbed earth in trenches, and patching’ the surface 4s an unsightly and unsatisfactory substitute for the original uniform surface. The late commissioner of streets in Philadelphia, in speaking of the cost of maintaining strects when the mains and gas and water connections ate permitted to be laid after the streets are paved, “It is this system which is really the bane of street paving. During the present year 22,000 breaks were made In the streets to permit the per- formance of work which might as well have been done before the pavements were laid.” And, pointing to a street in view, he said: rhat street has been repaired three times over the ditch dug by the underground telegraph com- ¥, and it is sinking again.” No labor or skill,” said he, “can ever repair over & drain and preserve the level of the street. In my opinion it would be advisable to compel the property owners to make water and sewer connec. nections before the streets are paved, and to grant no authority to tear up the streets under uny cir- cumstances in which it could be prevented.” ‘The report concludes as follows: “The Dill ask- ing for a charter for the United States Light and Steel Company for the District of Columbia 1s de- fective in many particulars. It places no restric. tions on the company in the issue of bonds, and provides no safeguards against injury to the pipes and property of the existing company as it should. The company, under this bill, may run under or over the present gas and water pipes in an ungclen- Ufle and careless way, and, as in cases heretfore when no remedy was provided for in the charter- ing of the new company, lead to continual injury to one or the other, to confilct and litigation. ‘The Washington Gas-light Company has no watered stock and no bonds. its stockholders are scattered from Alabama to Maine, but nearly one-half of the stéck is now held In the city of Washington, and stock in this company ts held py one hundred and sixty widows’ and orphans’ éStates, nearly all of whom reside in this District, to many of whom the loss of even one year’s dividend would Mean the deprivation of comforts, and to some the necessaries of life, Congress ought to look well into this matter before disturbing a con- cern in which so many people of this District are interested, and especially so when Congress has the laws already enacted, and has exercised the Fight, to fx the price and quality of the gas 601d in the District of Columbia.” ——— District Government Affairs, ‘THE FISH WHARV ES.
