Mr. Sleeman, of the Sixth Auditor's office, was called to identity vouchers for pay om the route. Mr. Bliss then took up the route from The Dalles to Baker City, Oregon, submitting the papers from the Post Office department relating to the route, ‘The reading of the papers consumed the morn- ing sesston. PROCEEDINGS APTER RECESS After recess Mr. Major, the sub-contractor on the Redding and Alturas route, came upon the stand to make some corrections in his testimony as to dates. John P. Fisk, who was employed as a carrier by A. W. Moore, on The Dallas and Baker City rout in August, 1878, was next examined. He testifi that Moore told hia, upon his representation that A semi-weekly route was Very hard to stock, that that was only temporary, as the route would be Increased. — Witness expressed doubts as to that, and said efforts had Deen made before to get It increased without success “Moore replied to that,” sald the witness, “that we NEVER HAD A SENATORIAL ROUTE BRFORE.” Objection was made to this, and the state- ment regarding the “senatorial route” was ruled out. Witness carried mat] on the route to the 15th Of April, 189, receiving his pay from the office of Miner, Peck & Co. at Canyon City, The route was increased from two to three trips a week in November, 1878 The tlme in which the witness carried the mail was never reduced, ‘The number of men and horses was not Increased during the witness’ service, after thes first month, The largest mail the withess ever carried was about 200 pounds, and the smallest between 30 and 40 pounds. Moore was about to return home and desired him to say to the court, in refer- ence fb questions propounded to him on cross-ex- amination, that Mr. Pelham was his counsel, but he waived the privileged character of his commu- nications with him and consented to Mr. Pelham's being fully interrogated regarding them. Mr. Davidge, rising, said, “On the other hand T have to assert that Mr.’ Pelham never was his counsel, and this isa mere device on the part of Mr. Moore to break down the force of the testi- mony of Mr. Pelham.” SOME DISCUSSION followed, in which Mr. Davidge protested that the interruption in the proceedings of the trial,to have an unsworn statement of that character made, Was very Improper. He said Mr. Boone very pro} erly sald what he did yesterday, because no found- ation for contradiction had been lafd in his case. “Itis wholly irregular,” continued Mr. Dav- lage, “for anybody to come into court and make aD unsworn statement.” imphbd therefore,” eaid Mr. Bliss, sit t entirety Improper for Mr. Da’ to gel and say Mr Peluiam 1s not Mr. Moore® atuoracy.” Judge Wylie said that this was a notice to the court, and he thought Mr. Moore's course was prover, in notifying the court that he had counsel ere. “We would be giad to have him remain,” said Mr. Davidge, “and contradict Pelham, ir he coul “Pelham won't contradict him,” said Mr. Mer- “We'll see about that,” said Mr. Davidge.
