Attorney General Brewster has given an opinion to the Secretary of War as to the construction of the clause in the act of June 30, 1882, as to limit- ing or restricting the retirement of officers of the army. He says that he Is of the opinion that in de- termining whether the limit of 400 prescribed by the act of 18th of June, 1878, have been reached or not, the number of officers retired under the act of the 30th of June, 1882, must always enter into the computation, so "that no retirement can valldly be made under the laws anterior to the act of the 30th of June, 1889, if the ate of retire- ments under that’ act ‘and the law preceding it shall at any time amount to four hundred. Congress has evinced no purpose in the act of June, 1882, to make a permanent increase of the number of the retired list, It 1s true that the list is subject to temporary augmentation beyond the said limit by retirements under that act, but this excess Is €) toconstant diminution and de- struction by occurrence of vacancies, ee eg Capitol Notes. ‘No agreement has yet been reached on the legis lative or deficiency appropriation bills.
