Tae Tanrrr Commrsston.—Numerous applica- tions have already been made to the President for appointments on the civil commission of nine per- sons authorized to be appointed, by the bill which recently passed both houses to revise the tariff. So nearly as may be it will doubtless be the pur- pose of the President to so form the commission hat all Interests and all sections will be repre- sented. The Pennsylvania delegation have united in a unanimous recommendation of Mr. Henry W. Olivet, jr., of Pittsburg, as a representative of the protection interest upon the commission. Mr. Oliver is a prominent iron manufacturer, and was the caucus candidate for the U.S. Senate from Pennsylvania when the present Senator Mitchell was chosen as a compromise. ‘Tae RESIGNATION of Second Lieut. Mr. Hobiitzell rising to a question of privilege in ‘the House to-day, stated that he had in January last Introduced a bill for the relief of Abraham Bratman, of Baltimore, and that it had been re- ferred to the committee on claims He had since learned that there was on the files of that com- mittee a communication addressed to the Speaker of the House and signed “Maryland,” reflecting on his (Hoblftzell’s) connection with the case. He contended that that communicaton was not prop- erly on file, and offered a resolution directing the committee on claims to Investigate into the con- duct of the clerk of that committee in con- nection with that communication, and report his action to the house. Mr. Williams, of Wisconsin, introduced a Dill authorizing the Secretary of State to take the necessary steps for the removal of the remains of the late Judson Kilpatrick from Chili to the state of New Jersey, for interment. Passed. Senate amendments were concurred in to House bill donating condemned cannon for monumental purposes, THE FORTIFICATION BILL PASSED. Mr. Forney, of Alabama, presented the confer- ence report on the fortification appropriation bill, and it was agreed to, THE GENEVA AWARD BILL PASSED. The House then resumed the consideration of the Geneva award bill. After brief speeches by Messrs. Hooker, Hammond (Ga.), Rosecrans, Ray, and Reed, Mr. House moved to lay the majority billand the substitute on the table. Rejected. The vote recurred on the substftute of the minor- ity and it was rejected, 48—109, The bill was then passed—yeas 132, nays 66. AGRICULTURE APPROPRIATION BILL PASSED. REPORT OF THE MEDICAL SOCIETY IN FAVOR OF PUBLIC ABATTOIRS. A committee of the Medical Society of the Dis- trict has sent to Chairman Neal, of the House Dis- trict committee, their opinion of the bill to estab- lish an abattoir in the District. If the blow pape to be inflicted in a post office, or acustom house, or any place under the jurisdiction of the United States where suitable accommodations were not made for the care of the sick the culprit is to go scot free. This Was the protection that the Constitution of the United States and the first Congress threw around Its officials, if such principles of law were well founded, but this was not the case. Mr. Davidge quoted King agt. Harcrave and the case of Grosvenor against the inhabitants of the land, showing how English authorities interpreted the Meaning of commission in a criminal case. Mr. Davidge, referring to the common law authori- ties as to definitions, said that when they sought the common law to explain a term in the Consti- tution or the statutes they went not to the twi- light of the common law but to the common law as It was understood by the men who passed the Jaw in question. It is the accredit rule that When the Constitution of the United es refers toaterm it is the acknowledged, accepted and recognized use and meaning of the word at the Ume of the passage of the act, and the rule is not then a very stringent one. ‘Mr. Davidge then quoted Waring agt. Clarke, 5th Howard, p. 441, in Support of this proposition: In further discussion ofthe question of jurisdiction Mr. Davidge, in urging THE INAPPLICABILITY OF ENGLISH RULES, sald that in America the powers of a grand jury and a petit jury always wait upon the jurisdiction of the court. The rule in America 1s essentially different from the rule in England, where the court conforms to the jurisdiction of the jury. IN SUMMING UP THE QUESTION OF JURISDICTION, he said, what a mockery it would be to try this Tan in New Jersey; for this great government to wait upon the state of New Jersey for the vindica- tion of its authority, This culprit had committed no crime against the majesty of the state of New Jersey. “What a picture,” sald Mr. Davidge, “to be presented to the world, that this government, insulted by the murder of its Chief Magistrate, absolutely had not the power of vindicating its law; but by a happy accident, merely, judgment is to be committed to the state of New Jerse: What is the state of New Jersey before the world— anonentity. Who knows the state of New Jersey. We know her. Sue is like the member of a family; known and S family, but of no use seq! side of the family. If this interpretation of the law is to prevail what a farce ts to be enacted before the nations of the earth.” Mr. Daviage said this ack of\iurisdiction had not been argued be- fore Judge coy but that judge had satisfied him- self upon the “point by methods of his own and methods that appeared all-sufficient. He sald that he himself, ten or twelve years ago, had occasion to defend a man named Walker, who had killed a man on Analostan island, the victim dying in Vir- ginia. Though it was not necessary to raise the point he had thoroughly explored the question, and derived from thai ae eee @ fixed opinion that this court had jurisdiction. Mr. Davidge said he had endeavored to treat the question from a high federal standpoint, while Judge Cox had treated it from the standpoint of a common law lawyer. He referred the court to Judge Cox’s exhaustive opinion regarding the question of jurisdiction. REFERRING TO EXCEPTIONS taken to the testimony of expert witnesses who had been asked whether they thought the prisoner knew the difference between right and wrong, Mr. Davidge declared that that was the only legal test in cases Of insanity. As to the witnesses interro- gated regal acts of misconduct upon the part of the prisoner, Mr. Dayidge said that the whole condition of things had been misrepresented in argument, The impression had been he feared, that Judge Cox had permitt testimony as to this misconduct in order to show braced a number of accounts against the book concern, and as to some there was a question of their legality. One was an account of Rowe & Lyon for rent, and a delegate said that when the ‘book concern was located In Kentucky a “ roaring Mon” got hold of it. During the morning Revs J. A. Handy, Mr. Wayman, 8. A. Johnson and J. H. Green, of the A. M. E. church, were introduced. Bishop Miles, after the items had been passed on, said he thanked God that he had lived to see the day when he could turn over the paper—the Christian Index—to them free of debt, and he made them a present of it. He remarked, however, that there was a small debt due him and asked when they could pay; he would like to have some of this amount today. Can’t you pay me the cents? he asked. * A member responded, “Yes, sir; I'll pay that.” ‘The committee then arose and reported to the conference. Rev. W. H. J. McDade, engaged in the mission work in Pennsylvania, was introduced and spoke of his work in Philadelphia, at Centerville, N. d., and Phillipsburg, N. J.
