Dorsey indictment in the star route cases was begun in the Criminal Court, Judge Wylie, yesterday afternoon, at 3 o'clock, a8 stated in'Tae Stan. When the reading was con- cluded Mr. Totten said that he had some specia! pleas in abatement to make, alleging that the grand jury found the indictment under undue influence, as parties not attached to the district attorney’s office (Messrs. Woodward and Tidbail, .O. department) had visited the jury room: The government counsel maintained that, it was T now to raise such a question. PROCEEDINGS TO-DAY. ‘This morning, at a few minutes past 10 o'clock, ‘the counsel appeared in court, and no less than frenty-nine the ee . Yolumes were brought in from MR. Before proceeding with his argument Mr. Inget- ‘Soll remarked that he had seen in the papers that one of the attorneys for the government was Goudtful, because of the treaty between the United States und Mexico, as to securing the attendance of ex-Senator Dorsey. He (the speaker) desired to say that the gentlemen on the other Side need not trouble themselves as to treaty stip- Fieger’ for Mr. Dorsey would be here next Mon- MR. TOTTEN’S ARGUMENT. Mr. Totten resumed his argument, claiming that the proper time to take advantage of misbehavior by the grand jury was after the indictment had been read, and by plea in abatement; reading a number of antuorities on the subject Bishop, Bacon and Chitty among others, Judge Wylie said he was entirely satisfied, if the plea was that one or more of the grand Jurors were isqualifid, it was « proper one. Mr. Totten sald the plea amounted to the same thing—that the grand jurors acted im roperty snd allowed Persons to inake arguments before them, =o WYLIE SAYS THEY CANNOT INVESTIGATE THE GRAND JURY. The court said they could not show that. The law would not permit them to enter the grand Jury room and investigate their proceedings. Messrs. Totten and Chandler read the paraet, which ts in the same words as Mr. Merrick suggested that the affidavit be read. TURNER'S AFFIDAVIT. ‘Mr. Wilson accordingly read the aMdavit of Tur- ner that Woodward was allowed in the grand jury Toom, where he read reports and ex parte state- ments of inspectors which were untrue, and that Z. T. Tidball, an inspector, also appeared before that body. ‘The aMdavit states that he has been unable to procure the aMdavit of the grand jurors; that fn April last Woodward made overtares to him to assist him to make a case, and when he truthfully stated that he knew of rothing on Which to make a case he threatened to have him lea of ose Of removed from his position in the Post Office de- Partment, which threat he believes Woodward carried out. DECISION OF JUDGE WYLIE, When Mr. Totten finished speaking Judge Wylie said he thought it would be economy of time to at ‘once announce the decision of the court. These parties have been aware of the existence of that Indictment frem that day tothis. They have already filed motions to quash one of those motions, sustained by twenty-two different specifications, and the other by seventeen. ‘These motions have been heard ana decided. Neither of those motions con. tained any reference to misconduct on the pirt of the grand jury. We cannot allow in the practice of the court a narty who has had ample opportu- nity to take advantage of an objection Felaeng to Ceo fnisconduct of agrand jury, then atter a time to make a motion to quash the indict- Ment on otter grounds. and rescve a portion of his objections for the purpose of sustaining a plea ofabatement when he 1s arraigned before the court and asked to plead to the indictment.” Alter further @onsideration of the question Judze Wylle said, “Iam therefore of the opinian that the ‘matter of this plea in abatement is not aliowa ble, and the court ought not to recetve it.” When the decision was announced Mr. Totten contended that the court had denied them the privilege of making the plea in abatement before his time. Exceptions were noted to the judge’s ruling and a proper record made. The defendants were called upon to plead, but sald nothing. The plea of not guilty was thereupon entered in the cages of Brady ‘and Tarner; Miner having pleaded “not guilty” yestertay, and Mr. Rerdell’s plea of misnomer being under consideration. THE PALPABLE DRIFT OF THE MORNING'S EXAMINATION was to bring out and define exactly how far the witness had gone in the direct attempt to influ- ence the official action of an official of the United States. Witness -was asked if Senator Blair as counsel was conferred with in gelation to the letter to Hurlbut in which he Sear] tendered him $230.00 of _—_stoe replied that Senator Blair did not see the letter to Mr. Hurlbut offering him $250,000 of stock.
