Erhardt was the owner and captain of the beat, but it was levied on by Constable Carter to satisfy the claim of the crew for money @ them for wages, Mr. A. B. Williams, defendant's counsel, claimed that a ves- sell ieensed the United States could not be at- tached. The court suid that the boat was taken by the defendant under a claim of right and not clandestinely, and therefore the offence could not be larceny, but trespass, and he would distniss the case.
