The frequency of this Class of killing makes law-abiding and well-dis- posed paople wonder why the crime of burglary has not long since been made a capital offence, + And punished accordingly. But evea more puz- ling than this problem {3 the question why Judges Who aiminister the criminal laws, and thus hive the safety of society so largely in their hands, do Rot, when they get a burglar before them, in- Yarlably impose the severest penalties provided by the Liws as they stand, instead of letting him off with the highest punishment possibie, asmany of them now do. Burglary fs that sort of a crime Which is entitled to no clemency whatever, nor to the benefit of any doubt, once the gulit of the malefactor ts conclustvely established. Mercy shown by a judge in such acas? ts therefore sim- ply a premium upon erirae, anda virtual turning over of community to the merey of the criminal classes. We remember an Instance tn point in this city Which occurred several years ago. A burglar Whose general bad character was well known tothe authorities, and whose gulit as charged had been clearly proven, was before the court for seatence. ‘The prosecuting officer plead earnestly for the Severest punishment possible, and all the eircum- Stance of the case notoniy fustified, but demanded compliance with the request. The judge, how- ever, in the goodness of his heart concluded to let the culprit off with a sentence of fmprisonment in a distant penitentiary for something less than halt the maximum term allowed by law, instead of im- Posing Its severest penalty, as he might and ought tohave done. What was the result? The fellow went to prison; but by a simulation of penitence anda parade of good behavior he secured an ab- Dreviation of his term, as provided In such cases. On being Uberated he returned directly to Wash- inzton, and before the expiration of the period for Which he was originally sentenced he was again arrested for burglary, and in due time convicted and again sent to the some prison. Now, it would perhaps be too much to charge ‘that the good-hearted judge was a particeps crim=- ‘tis in the second offence; but surely it would have been no great hardship if the second victim Of the prisoner could have recovered the value of his stolen goods from the man who had thus placed Bim at the mercy of a professional housebreaker. But for tse lentency of the judge in the first in- @ clearly would not have been robbed as _/The people of New York, without regard to poli- ‘ties, are thoroughly disgusted With Tammany and its piratical conduct. The organization 1s main- tained with but one object in view—that of obtain- ing poiifical spolls—and it is not at all particular a8 to the methods employing in attaining that end. Tammeny has got to be a guerrilla Jn political warfare; without any fixed principles, not profess- ing allegiance to either of the two great parties, Dutstriking at both or either whenever an oppor- tunity to capture a Little patronage offers. The or- ganization is in such bad order that neither politi- eal party can openly acknowledge alliance with it. ‘The present attitude of Tammany tn relation to the organization of the legislature may, happily, Jead to the final extinction of the organization. ‘The few Tammany members of the legislature hoid the belance of power in that body, and they are, apparently, determined to make this advan- ‘taze bring them the highest possible price. Ina confereace with the democratic members the Tam- Manyites made no concealment of their sordid Schemes. They offered their votes in support of a @emorrstic organization of the legislature upon @ertain named conditions, which comprised the Major part of the oMcers to be elected. The dem- @erats refused to pay the price, and the republl- ans tn the legislature have publicly declared that they witi not cater into any sort of bargain or trade with Tammany. Another deadiock of the legisla- ture, with political spoils as the objective point, Is threatened, ata time when the pubite business of the st:ts, which was neglected by the last legista- ture, because of a political Nght, ts calling for at- ettion. If the republicans and democrats are wise, will aveld a prolonged contest over the Orguntzation and strike Tammany a hard,perhaps, @ fatal blow, at the same time. They can effect an orgcniz:tion upon some compromise basis, and go @head with the public business.
