Julia A- Rupp agt. Metropolis Lodge, No. 16, I. O. O. F., was tried. Mrs. Rupp claimed that she was entitled to the widows" tax in consequence of the death of her husband, who she claimed wasa member Of the order in good at the time of Dis death. The defendants claimed that in Consequence of bis failure to pay dues he was Rot entitled. The defendant asked for a ver- dict on the ground that it had not been shown that the lodge was a chartered body. The Court sald that !f the Grand Lodge of this 5 yn Was a Chartered body, and had the | ap to issue Charters to subordinate lodges, Should hold that this was a quasi char: tered body. A copy of the charter of the Grand —— was read, and it was found that 1t had not been given any power to Issue-chartera to the subordinate lodges. It was then stated by the Counsel as @ fact. that none of the lodges poseessed charters and never had been granted any. The court said this was a remarkable circumstance, and that the bodies held a much Gifferent position from what he had supposed. ‘They were utterly without avy respouaibility; they could receive funds and not be heid ac Countable for them; they could nelther sus nor be sued. HOW THE CASH WAS TO HAVE BEBN OBTAINED. Naturally the officers and directors were anx- ious to know to what extent It was intended to carry out the fraud, and some were quite sure that It was not simp-y the security of a certi- ficate that was wanted, but that the real ob- ject was the cash itself.
